Show I ORDINANCE 03-90 AN ORDINANCE AMENDING ORDINANCE NO. 09-86 ESTABLISHING ESTAB-LISHING THE SALARY OF THE DAVIS COUNTY ATTORNEY WHEREAS, historically, the position of Davis County Attorney has been occupied oc-cupied by attorneys who have maintained maintain-ed a private practice; and WHEREAS, beginning in 1984, the Davis County Commission and the Davis County Attorney began the implementation of a program for training train-ing and retaining Deputy County At- tomeys in both the criminal and civil aspects of the County Attorney's office; and WHEREAS, the demands on the office of-fice of County Attorney continue to increase in-crease commensurate with the increased' civil and criminal work load of the office; of-fice; and WHEREAS, as an incentive for the County Attorney to devotQ full-time to the office of County Attorney, the County Commission desires to establish a salary level for the County Attorney with private practice and a salary level for a County attorney without private practice. NOW, THEREFORE, the Board of County Commissioners of Davis County, Coun-ty, State of Utah, ordains as follows: Section 1 , That pursuant to the provisions provi-sions of Title 17t Chapter 16, Section 14, UCA (1953) u amended, and after a public hearing duly held in accordance with said law, on June 27, 1990, the annual an-nual salary for the Davis County Attorney At-torney who maintains a private practice shall be $44,002.00, effective July 1, 1990. Section 2- Effective July 1, 1990, the annual salary for the Davis County At tomey who maintains no private practice prac-tice shall be $62,500.00. Any County Attorney being paid pursuant to this Section 2 shall be required to maintain time records and demonstrate to the Davis County Commission that he or she complies with guidelines controlling controll-ing private legal practice for deputies of the Davis County Attorney adopted by the County Commission. Section 3. all ordinances in conflict with this ordinance are hereby repealed. Section 4. In the opinion of the County Coun-ty Commissioners of Davis County, this ordinance is necessary for the peace, health and safety of Davis County and the inhabitants thereof. Therefore, this ordinance shall become effective immediately im-mediately upon its passage and upon a copy being published in accordance with law and a copy being deposited in the office of the Clerk of Davis County, Utah.
