Show j Groups seeking more time PSC denies petitions By BRUCE LEE Record Editor SALT LAKE CITY The Utah Public Service Commission has denied petitions by four different groups to put off a decision regarding the proposed sale of CP National utility properties in southwest Utah to Utah Power & Light. The petitions for stays of the controversial con-troversial decision were denied Apr. 14, according to David Stott, PSC executive secretary. In discussing he denials, Stott said, "I would assume that all the obstacles have been cleared out of the way and a decision will be forthcoming." j Southwest Utah Cooperative Powdr Federation President Carl Palmej" agreed, saying the decision whether to allow the sale or deny it could come as early as this week. The decision to not allow more tme is generally seen as a blow to the Federation. "Of course we're disappointed," disap-pointed," said Palmer. "However, we will be in the (Utah) Supreme Court within two hours of the decision if it's against us," he added, referring to an appeal that will be made. The Federation is also currently before the Utah Supreme Court concerning con-cerning . condemnation proceedings it has filed. The four committees asking for more Fadel, representing the mayors, argued that the decision should be delayed to give communities in the area the chance to investigate the possibility of negotiations with UP&L. Such negotiations had been hinted at earlier by UP&L spokesmen. Both petitions were denied because the negotiations are not currently going on, said Palmer. James Barker, representing the Committee of Consumer Services, asserted that the facts of the case had changed materially, including rate increases by UP&L. This argument was rejected, said Palmer, because the CCS had had a chance to enter the hearings earlier and had not. time were the Utah Committee of Senior Citizens, the Parowan Valley Pumpers, the Committee of Consumer Services and a group of mayors from southern Utah. Bruce Plenke, attorney for the senior citizens, asked for the stay based on reported statements by UP&L officials to the commissioners after the hearings. His request was denied because the remarks were not contained in the official hearings, from which the commissioners will make their decision.
