The Mayor and City Council of SpringviUe City shall appoint employees em-ployees as may be required for the operation and maintenance of said Waste Removal Department and fix their compensation, and shall have power to remove such employees em-ployees without cause. Section 2. Duties of Superintendent Superintend-ent of Streets and Walks in Connection With Waste Re-moval Re-moval Department. The said Superintendent of Streets and Walks shall have charge of the Waste Removal Department, De-partment, and all property of the city used by the said Department. He shall manage efficiently the system of collection and removal of garbage and waste matter in accordance with law, and under the direction of the Mayor and City Council. Section 4. Definitions. (a) For the purpose of this ordinance, or-dinance, the word "garbage" shall be held to include and mean kitchen kitch-en and table refuse, leavings and offal, swill, and also every accumulation accu-mulation of animal and vegetable and other matter that 'attends the preparation, consumption, decay of or dealing in or storage of meats, fish, fowls, birds, fruits and vegetables. (b) The term "waste matter" shall include and be held to mean crockery, bottles, tin cans, metal vessels, trimmings from lawns and gardens, pasteboard boxes, berry boxes, rags, paper, straw, sawdust, or ashes. Section 5. Unlawful To Dump or Bury. No person, firm or corporation shall, for the purpose of final disposal dis-posal thereof, dump, place or bury in any lot, street, land, or in any alley, or in any water or water- . 4 in the corporate limits of the City of SpringviUe from time to time to examine the sanitary conditions condi-tions of said premises -to determine deter-mine whether the provisions of this ordinance are being complied with. Upon notification by the Superintendent, or his representative, representa-tive, all persons, firms, or corporations, corpora-tions, shall within three days after notice, comply with the provisions pro-visions of this ordinance or be deemed guilty of a misdemeanor. Section 12. Garbage for Hog Feed. Whenever the Superintendent of Streets and Walks shall determine that the garbage from any premises prem-ises is suitable for hog feed, and shall so notify the occupant of such premises, such occupant shall thereafter deposit the garbage designated as hog feed in a separate separ-ate garbage container and shall' keep such garbage free of any rubbish, tin cans, glass, coffee grounds, egg shells, paper, or other indigestable materials. , No charge shall be made for the collection col-lection and disposal of garbage that has been designated as hog feed, except that the regular charge shall be made, if hog feed is mixed with other garbage or waste matter. Section 13. Only Authorized Agents To Collect Garbage. It shall be unlawful for any person, per-son, firm or corporation, other than the Waste Removal Department Depart-ment of SpringviUe City, to collect, remove or dispose of garbage in SpringviUe City. The provisions of this section shall not apply to any person transporting his own garbage andor waste matter to the Sanitary Fill of SpringviUe City, or to places outside the corporate cor-porate limits. Section 14. Collection of Garbage. Removal of garbage or waste matter. from the premises of the subscribers for such service herein provided, shall be made at least once a week from private resi- Section 18. All persons desiring garbage or waste removal service shall make application in writing, upon a form provided therefore, to the City Recorder of SpringviUe City, together with one dollar deposit or application charge for service specifying the service required and agreeing to pay the rates fixed for such service, according to the terms specified on said application. applica-tion. . , Section 19. Power of Superintendent. Superintend-ent. The Superintendent of Streets and Walks of SpringviUe City shall only be charged with the enforcement en-forcement of such rules and regu-' lations pertaining to the Waste Removal Department as may be established by the City Council of SpringviUe City, consistent with the provisions of this ordinance, governing the keeping, collection, removal and disposal of garbage and waste matter. Section 20. Penalty For Violations. Viola-tions. Any voilation of this ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred ninety-nine dollars ($299.00) or by imprisonment not exceeding six months or by both such fine and imprisonment. Every violator of the provisions of this ordinance shall be deemed guilty of a separate offense for every day such violation shall continue, and shall be subject to the penalty pen-alty imposed by this section for each and every such separate offense. of-fense. ' Section 21. Constitutionality of Ordinance. If any section, sub-section, sentence, sen-tence, clause or phrase of this ordinance is for any reason held to be invalid, or unconstitutional, such decision shall not effect the validity of the remaining portions of the ordinance. Section 22. Sections of Ordinances Ordin-ances Repealed. All other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 23. Date Effective. In the opinion of the City Council Coun-cil of SpringviUe City, it is necessary neces-sary to the peace, health and safety safe-ty of said City that this Ordinance become operative immediately; that an emergency is hereby declared, de-clared, and that this Ordinance shall be published in one issue of the SpringviUe Herald, a weekly newspaper printed and published in SpringviUe City, Utah County, State of Utah, and shall be in force and take effect immediately upon the day of its passage, approval ap-proval and publication. Section 6. Unlawf ul To Permit Garbage or Waste Matter To Accumulate. No person owning or occupying any building, lot or premises in SpringviUe City shall suffer, allow or permit to collect and remain upon said lot or premises any garbage, gar-bage, as defined in Section 4, for a period of more than one week, or any waste matter for a period of more than two weeks. Section 7. Garbage Can and Refuse Re-fuse Receptacle. Every owner, tenant, or occupant occu-pant of any premises where garbage gar-bage is created shall provide upon such premises, in a suitable place, one or more galvanized metal garbage gar-bage receptacles, with tight fitting fit-ting galvanized metal cover, for receiving and holding all garbage created upon such premises between be-tween the times of collection and removal. Every owner, tenant, or occupant of any premises where waste material is created shall, where necessary, in addition to the garbage receptacle, provide upon such premises in a suitable place, one or more receptacles, or depositories, deposi-tories, acceptable to the Superintendent Superin-tendent of Streets and Walks, to dences and as many times per week as the Superintendent of Streets and Walks of SpringviUe City may order from all meat, fish, game, and vegetable markets, mark-ets, restaurants, boarding houses, hotels, hospitals and other like places. Section 15. Sanitary Districts. The Mayor and City Council of SpringviUe City, by resolution may divide the City -into sanitary districts dis-tricts for the purpose of collecting garbage and waste matter. . Section 16. Rates For Collecting Garbage. For the services of the Waste Removal Department of SpringviUe Spring-viUe City, in collecting and disposing dispos-ing of garbage and waste matter, the owner, tenant, or occupant of each place from which garbage or waste matter is collected by the City, and each person disposing of his own garbage or waste matter at the Sanitary Fill, operated by SpringviUe City, shall be charged such rates as may be established by resolution of the Mayor and City Council of SpringviUe City. Said charge shall be deemed to be a civU debt owing to SpringviUe City from the occupant of said property. Section 17. Waste Removal Fund. The City Recorder of SpringviUe City shall place said charge on the monthly electric light statement and upon collection of the same, it shall be placed in the City Treasury Treas-ury in a seprate fund to he known as the "Waste Removal Fund" and disbursed by the City Treasurer Treas-urer with the approval of the City Council. GARBAGE DISPOSAL ORDINANCE An Ordanance Creating a Waste Removal Department for SpringviUe Spring-viUe City, and providing for the removal and disposition of garbage gar-bage and waste matter. Revising Revis-ing all other Ordinances of SpringviUe, Utah, or parts of Ordinances in conflict herewith. Be It Ordained by the City Council Coun-cil of SpringviUe, Utah: Section 1. Creation of Department Depart-ment and Purposes, There is hereby created a Waste Removal Department of SpringviUe Spring-viUe City. Said Department shall be managed, operated and supervised super-vised by the Superintendent of Streets and Walks under the supervision of the Mayor and City Council. The Waste Removal Department shall be charged with the responsibility respon-sibility of operating and maintaining maintain-ing a garbage and waste matter collection,, removal and disposal system for the purpose of collecting collect-ing and removing garbage and waste matter from the residences and business houses of the subscribers sub-scribers for such service within contain all waste' matter which may accumulate upon such premises prem-ises between removals. All subscribers sub-scribers for service, as herein provided, pro-vided, shall at all times locate such receptacles at places so as to be readily accessible for removing and emptying the same, but they shall not be placed within the limits lim-its of any street, or alley within the corporate limits of SpringviUe City, or anywhere so as to constitute con-stitute a nuisance. Section 8. Can Must Be Clean. All garbage and waste matter receptacles shall be kept in a clean and sanitary condition by the owner own-er or person using the same, and garbage receptacles shall be kept tightly covered at all times except when garbage is being deposited therein, or removed therefrom, and shall at all times be proof against the access by flies to the contents thereof. Section 9. Garbage Must Be Placed In Can. All garbage shall be placed in the garbage receptacle required by Section 7 of this ordinance. .All waste matter must be placed in the receptacle, or depositories provided pro-vided for said waste matter, or in the garbage receptacle. Section 10. Liquid Garbage. No liquid garbage shall be deposited de-posited with any garbage or waste matter. All kitchen garbage shall be drained of all moisture and completely wrapped in paper before be-fore being placed in the garbage container. Section 11. Inspection. The Superintendent ,, of Streets and Walks of SpringviUe City, or other duly authorized representatives, representa-tives, shall visit all premises with- |
