Show PLEASANT VALLEY COAL WINS ACTION Judge A. H. Cliristensen of Seventh District Dis-trict Decides Against Ketchum Company Com-pany in Condemnation. The formal findings and judgment of Judge A. 11. Cliristensen of the Seventh judicial circuit, in the matter of the condemnation con-demnation of the Ketchum Coal company com-pany against the Pleasant Valley Coal com pany. were rendered Saturday in Price. The decision was in favor of the Pleasant Valley Coal company, which was represented bv A'an Cott. Ellis & Hiter 01 this city; Dixon. Ellis, Fills & Schulder, also of this city, and R. G. Lucas of Denver, Den-ver, assistant general attorney of the Denver fc Rio Grande railroad. The presence pres-ence of Mr. Lucas in the case was owing to the fact that the D. & R. G. road was named as co-defendant. Boyd, Devine & Eecles of Ogden were the attorneys for the Ketchum Coal company. The suit was the result of an effort of the plaintiff, the Ketchum Coal company, com-pany, to secure a site for a tipple, as well as traffic facilities, in order to operate its property. The court held that the property sought was already in use by the defendants, and refused the right to condemn it. Notwithstanding the plaintiffs plain-tiffs claimed that the title vested In the defendants was not properly acquired, the court held otherwise. |
