Show The Vernal City Council has given General Properties, Inc., which owns the culinary water system of Air Village Hills Inc., 90 days to come within the bounds of its contract or negotiate a new contract with the city or its water will be turned off. The action was taken by the city after five residents of Air Village requested their own water be turned off im- mediately because of the breach of contract. con-tract. "It is the principle of the thin) " sid George Millecam, director of the Homeowners Association (a cooperative of the residents of Air Village). "If he (Lyle McKeachnie) gets away with it this time, there's no stopping him. "We are not interested in getting our water turned off, we want to stop this thing before it gets to the whole district," Millecam added. According to the contract between Vernal City and General Properties, the city will provide water for 27 connections con-nections and Lyle McKeachnie has sold 36, said Dan Coney, resident of Air Village Hills. "He has sold something he hasn't got," Coney continued. Besides the 36 water connections, it was stated that McKeachnie has breached his contract by extending his water iines past the boundaries described describ-ed in the contract. City Attorney Richard Davidson told the council that this is a major breach of contract and time should be given for Air Village to comply or to negotiate a new contract. According to McKeachnie, major owner of General Properties, he has not broken the contract with the city. "In the contract the city promises to provide water for Air Village Hills (117 connections), if they have water to deliver," McKeachnie said. "If they cut me off they have to cut off others who the city is selling surplus water to." (Continued on Page 16) Water system. . . (Continued from Page 1) McKeachnie justifies the connection he made outside the boundaries of his contract by saying, "as of Nov. 7, Air Village became part of the district." "The connection is in the Ashley Valley Water and Sewer District." "The new connection will provide water for people who have been denied water by the city for 18 years." McKeachnie "said he didn't know if the connection was charged before Nov. TOTAL 7 or not. TOTAI A letter was sent from the city dated Aug. 7 to McKeachnie warning of infringing infr-inging the contract. Shane Luck, city manager, denied any charge that the city refuses water and said those people are on the City's Master Plan and the council moved to provide them with water as soon as possible. "It is not right for the whole valley to pay a 4 percent mil levy so Air Village Hills can have water," Coney added. "Our concern doesn't involve personal per-sonal problems with Lyle, this just has to be stopped," Coney concluded. |
