Show LIQUOR CASE DISMISSED. Prosecution Fall to Substantiate Charge-s Agalnt James Dm I ton. Special to The Tribune. OGDEN, Oct. 2. The case of Morgan City against James Dalton, charged with the illegal sale of liquor, was dismissed in the district court at Morgan today, after the prosecution, which was represented repre-sented by District Attorney John C. Davis, failed to substantiate the allegation allega-tion both under the state law and the ordinance. At the beginning of the hearing George Halvereon, attorney for Dalton, raised the point that the charge could not be prosecuted because of the claim that the ordinance on the subject was invalid, not having been given the proper publication, and was sustained. Then the prosecution began proceedings under the Utah statute. Halverson argued that the charges against his client were flimsy and secured immediate im-mediate dismissal. Dalton was arrested two days ago. |
