Show COMMIT LOSES IN A SUIT FOR EXTRA CHARGES Judge J A. Howell has rendered a decision in the case of the San Pedro Railway company against W. F. Russell Rus-sell In favor of the defendant In amount the suit was of little importance, impor-tance, but in settling a law question It Ib of considerable moment The company agreed to ship a car of household furniture for the defendant defen-dant from Provo to Riverdalo for $30, but afterwards demanded $48 for tho transportation, the defendant refusing to pay more than had been agreed upon. The plaintiff company contended that, inasmuch as its tariff filed with tho Interstate Commerce Commission was $IS, it should be paid that amount Tho court's ruling was that, had the shipment been of an interstate nature, the company no doubt could have recovered the difference between $30 and $4S, but It being Intrastate transportation, it would be required to stand by Its agreement with the de-fondant de-fondant and could not recover. , ,,rfi . . |
