Show PROMOTER FRENCH MAY YET BE HELD Salt Lake Jan. 29. County Attorney Attor-ney I. E. W'lljey was notified yesterday yester-day that Governor Johnson of California Califor-nia would hold the extradition proceedings pro-ceedings In the case against C. W French, promotor "de luxe," In abeyance abey-ance pending a further request for action by the Utah authorities. Governor William Spry also received re-ceived a telegram from the California executive that he would honor any requisition Issued In good faith and In accordance with the statutes. County Attorney Willey at once proceeded pro-ceeded with the "preparation for tlio filing of another complaint against French charging him with embezzlement embezzle-ment In the sum of $1400. The complaint com-plaint will be based upon the second of the two drafts"' drawn by French which were protested and returned to the Hotel Utah, by which they were cashed. Tlie second draft was drawn upon J. E. Clark of Los Angeles, who has been acting ns attorney for French. County Attorney Willey has refused to turn over to Attorney Benjamin L. Rich the protested Von Cramer draft in consideration of the lawyer's paying pay-ing $1000 to the Hotel Utah. The county official is insistent upon getting get-ting French to Utah and not allowing any financial settlement of the case. However, at the hearing on the extradition extra-dition in Sacramento an affidavit was filed by Von Cramer that the draft for $1000 had never been presented to him in person and hence could not, or should not have been protested! The draft, however, was returned by the Vancouver Trust company, a concern con-cern with which Von Cramer was doing do-ing business, and which notified the hotel and the county attorney's office that it had no funds to Von Cramer's credit with which to meet the paper. This technicality, it was feared bv county Attorney Willey might result in the release of French "and hence the proceedings on the $1400 draft has been started. This draft, it Is understood, under-stood, Is drawn directly on Clark and the protest Is said to show that he refused re-fused to honor it County Attorney Willey last night refused to make formal statement of how he will proceed in the case, but is is expected that within a few days the complaint will have been prepared pre-pared and telegraphed to the California Califor-nia city asking that French be held. In the meantime extradition papers will be issued by Governor Spry, It Is said, and a representative of the county coun-ty attorney's office will go to Sacramento Sacra-mento to place the evidence before Governor Johnson in case French should refuse to return to this state. oo |
