Show ELECTION NOTICE TO ALL QUALIFIED ELECTORS OF THE CITY OF ST. GEORGE CITY, UTAH: Take notice that on the 6th day of May, 1941, an election will be held in the City of St. George City, Utah, at the places set out in the following ordinance, and for the purpose of submitting to the qualified voters of said City the question set out in an ordinance ordi-nance adopted by the City Council Coun-cil on April 1st, 1941, which ordinance ordi-nance is as follows: ORDINANCE NO. 101 AN ORDINANCE providing for the holding of a special election elec-tion in the City of St. George City, Utah, for the purpose of submitting to the qualified electors elec-tors thereof the question of adopting an initiative ordinance with respect to the issuance of $300,000 Electric Revenue Bonds of said City. WHEREAS, there has this day been presented to the City Council Coun-cil an initiative petition requesting that the City Council adopt the ordinance therein set out or submit sub-mit such ordinance to the vote of the qualified electors of the City of St. George City for adoption, said ordinance being entitled: "An Ordinance providing for the acquisition of a municipally owned electric generating plant and electrical elec-trical distribution system by the City of St. George City, Utah; authorizing and providing for the issuance of $300,000 Electric light and Power Revenue Bonds of said City for the purpose of defraying defray-ing the cost of such acquisition; prescribing the form and other details de-tails of said bonds; providing for the collection and disposition of the revenues to be derived from the operation of said plant and system; making other provisions with respect thereto and providing for the payment of said bonds;" and WHEREAS, it has been ascertained ascer-tained by the City Council that at the last preceding election for governor held in the City of St. George City there were cast for all . candidates a total of 1490 votes, and it has been determined by the City Council that the initiative initi-ative petition for the above entitled en-titled ordinance is signed by 274 legal voters qualified to sign 'said petition, and that said petition contains the number of qualified signers required by .Chapter X of Title 25 of the Revised Statutes of Utah, 1933; and WHEREAS, said initiative petition peti-tion has been in all respects carefully care-fully examined and has been found by the City Council to be full and complete, and to comply in all respects with the requirements of said Chapter X; and WHEREAS, the ordinance set out in said petition has been adopted by the City Council subject sub-ject to approval of the qualified electors of the City of St. George City, and it is desired to call a special election at which the question ques-tion of the approval of said ordinance ordi-nance may be referred to the electors elec-tors of the City of St. George City qualified to vote thereon; NOW, THEREFORE, Be It and It Is Hereby Ordained by the City Council of the City of St George City, Washington County, Utah, as follows: Section 1. That there shall be held in said City on the 6th day of May, 1941, between the hours of seven o'clock A. M.. and seven o'clock P. M., a special election at which there shall be submitted to the legal voters of said City the question of the approval of the ordinance described in the preamble pre-amble hereto. Section 2. That all electors of the City of St. George City qualified quali-fied to vote on said proposition under the provisions of the consti tution of Utah and Title 25 of the Revised Statutes of Utah, 1933, as amended, shall be permitted to vote at said election. Section 3. That the polls- shall be opened in every regularly established es-tablished election district of said City on the day of said election, which districts, voting places and the election officials to serve in each district, are as follows: District Number 10, East Precinct; Pre-cinct; Voting Place, Annie C. Johnson Residence, 83 E. Tabernacle Taber-nacle St.; Election Officials, Judges of Election, Charles Walter Wal-ter Cottam, Ambrose Cannon, Sabra Foremaster; Constable, Emerald Em-erald Cox. District Number 11, West Precinct; Pre-cinct; Voting Place, A. B. Andrus Residence, 108 So. 100 West; Election Officials, Judges of Election, Elec-tion, Jessie Empey, J. R. Fawcett, Faw-cett, W. A. Whitehead; Constable, D. Wilson Woodard. Section 4. That the registration registra-tion agents for the several election elec-tion districts of said City shall, between the hours of eight o'clock A. M., and nine o'clock P. M., on the first and third Tuesdays immediately im-mediately preceding said election, receive and register the names of all persons applying for registration registra-tion who are legally qualified and entitled to vote at such election or who will legally have acquired a residence (being otherwise qualified), qual-ified), and who will have a right to vote at said election according to the provisions of the law under which said election is to be held. Section 5. That the registration registra-tion agent for each election district dis-trict shall post in at least five (5) conspicuous places within his district at least (5) days prior to the date fixed for said election the following election notice, which notice shall also be published pub-lished once a week for not less than four consecutive weeks in five issues of the Washington County News, a newspaper published pub-lished and enjoying a general circulation cir-culation in the City of St. George City: (Here follows the form of notice hereby given.) Section 6. That said election shall be held in all respects, and notice thereof shall be given in all respects, as required by the general laws of Utah pertaining to special municipal elections. Section 7. That the proposition to be submitted, and the ballot to be used at said election shall be substantially the following form, it being understood that said ballot bal-lot shall comply in all respects with the requirements of Chapter X, and Section 5 of Chapter VI of Title 25, Revised Statutes of Utah,' 1933, as amended: ORDINANCE NO. 100 An initiated ordi- ! nance adopted on April 1st, 1941, subject to ap- FOR proval by the voters, authorizing authoriz-ing the acquisition acqui-sition of an elec- AGAINST rJ trie light and power plant and system by St. George City, and to pay therefor by issuing $300,000 4 and 4' Electric Revenue Bonds payable solely from revenues derived from the operation of said plant and system remaining after the payment pay-ment of necessary operation and maintenance expenses, said bonds not to be a general indebtedness or obligation of St. George City, and accepting the bid of Edward L. Burton and Company of Salt Lake City, Utah, for the purchase purch-ase of said bonds. The ballot title appearing in said ballot has been provided by the City Attorney and approved by the City Council. Section 8. That the City Recorder Re-corder is instructed and directed to prepare the publicity pamphlet required by Sections 18 and 23 of Chapter X, Title 25, Revised Statutes of Utah, 1933, to incorporate incorp-orate therein the arguments for and against the measure filed with him, in accordance with the provisions pro-visions of said Section 23, and to distribute said pamphlets to every voter of the City of St. George City, either by mail or carrier, not less than eight (8) days prior to the date herein fixed for the election, at which said proposition is to be voted upon. Section 9. That immediately after its adoption this ordinance shall be signed by the Mayor and City Recorder, shall be recorded in a book kept for that purpose, and shall be published in the Washington County News, a newspaper news-paper published and having general gen-eral circulation in the City of St. George City, and shall take immediate im-mediate effect, the preservation of the peace, health and safety of the City of St. George City so requiring.
