Show CITY'S DEMURRER IS SUSTAINED BY COURT In sustaining the city's demurrer in the suit brought by E. MeCov to recover $5000 worth of confiscated liquor. Judge Harold SI. Stephens of the Third district court has put court confirmation on the prohibition law of the state in its denial of property right in prohibited liquors. Under the ruling of Judge Stephens the plaintiff is given ten days in which to answer. Tho liquor was confiscated last August by the police, after being dug out of McCoy's Mc-Coy's garden in the southwest part of the city. It Is now in the evidence room at police headquarters and suit was directed di-rected against .1 Pcriey White, chief of police. -as the cufodiiyi. Unless the case is appealed to the supreme court, the liquor will now be turned over to the federal fed-eral government in accordance with instructions in-structions received hv Governor P.ambcr-1 P.ambcr-1 per will regard to all confiscated liquors. |
