Show CSIICTS TO PIE FORMALLY AWARDED City Commission Also Opens Other Bids in Face of Protest. After arguments that consumed the better part of the forenoon session of the city commission yesterday, a formal for-mal contract for the paving of Eighth East street from South Tempe to Fourth South streets arid Fourth South street from Seventh to Tenth East streets, was awarded to Parrott Brothers, Broth-ers, contractors. Contractor J. V. Mellon, Mel-lon, through his attorney, Bernard J. -Stewart, was the protectant, while Attorney At-torney Carl A. Badger rej)resented Parrott Par-rott Brothers. The action of the commission followod the district court decision dissolving the injunction proceedings brought by Mr. Mellen to restrain the city from awarding the contract for the paving of tho two streets to Parrott Brothers. Mr. Mellen, together with J. W. Clark, contractor, con-tractor, sought the prevention of the award of the contracts to Parrott Brothers Broth-ers on tho ground that the -city engineer engi-neer had not given out plana and specifications speci-fications in sufficient time for contractors contrac-tors to return proper bids. At yesterday's meeting of the city commission it was intimated that Mr. Mollen would appeal from the decision of the district court, and Mr. Stewart suggested that under this situation the award of tho contract to Parrott Brothers Broth-ers might result in a serious delay to the street paving projects. Mr. Stewart asked that bids tor the work should be readvertised, which would mean but a dt'lay of twenty days. He also pointed out that should Mr. Mellen win his case the citv warrants for the improvements might be invalidated. Following the action on tho Parrott Brothers contracts the commission opened bids on six other street paving improvements which had been held up pending the court's decision. These bids were sent to the city engineer for tabulation. tab-ulation. Mr. Mellen, through his attorney, attor-ney, although entering three bids for contracts, also entered a formal protest against the award of any of these contracts. |
