Show BREEDEN 'S NONSENSE. Wo notice that Altorncj'-Gencral Breeden persists in his childish plea for the elimination of tho word "polygamy" "polyg-amy" from our criminal statutes. a''l the substitution iu lieu thereof of the word "bigamy." Wo do not know what incitement lias led this distinguished humorist to press this particular point. In pressing it. ho seems to lose sight altogethor of historical perspective, and of the significance of the word as used iu our criminal statutes, and as carried in the pledge mado by Utah to tho Nation Na-tion with respect to polygamy, Mr. Breeden alleges that tho word "polj-gamy" is not in use iu other States, aud thnt in Utah alono it is put in tho statutes. Which may very well be, since Utah is the ouly State admitted to the Union under the distinct dis-tinct nnd precise pledge that polygamy must ever remain a criminal offense within the State. Utah was required in the enabling act to incorporate this ban of polygamy, and to maintain the laws against polygamy as they existed. And that is the full aud sufficient reason rea-son why tho word "polygamy" is used in Utah, and not in other' States; and it. is also a full and sufficient reason why tho word "polygamy" should be retained. " Unquestionably the changing of this word would be construed throughout the country as meaning au attempt to depart from tho pledge offered with regard re-gard to the compact on polygamy made by the State. And since it would ccr-tainl- have that" effect in the country at large, and siucc the country would be amply justified in construing it as at least a technical repudiation of its compact with the Unitod States, wo sec no reason whatever why the State should coincido with Attornoy-Geueral Breeden Bree-den 's silly, if not repudiating, suggestion in this respect. The word should be retained, re-tained, precisely as the agreement with the United States has required that it should be retained. The Legislature would be doing itself and the State a great injustice and would be bringing the whole community into obloquy if it should seriously think of carrying out the Breeden suggestion. |
