Show ORDINANCE NO. 263 AN ORDINANCE SAFEGUARDING PERSONS AND PROPERTY AND PROMOTING THE WELFARE WEL-FARE OF THE PUBLIC; THE PROVIDING FOR THE APPOINTMENT AP-POINTMENT OF AN ELECTRICAL ELEC-TRICAL INSPECTOR; ESTABLISHING ES-TABLISHING STANDARDS FOR ELECTRICAL EQUIPMENT EQUIP-MENT AND THE INSTALLATION INSTALLA-TION THEREOF; MAKING IT UNLAWFUL, EXCEPT AS OTHERWISE PROVIDED, TO UNDERTAKE THE INSTALLATION INS-TALLATION OF ELECTRICAL ELEC-TRICAL EQUIPMENT WITHOUT A STATE CONTRACTOR'S CON-TRACTOR'S LICENSE; PROVIDING FOR ENFORCEMENT ENFOR-CEMENT OF THIS ORDINANCE OR-DINANCE AND PENALTIES FOR VIOLATIONS; REPEALING ALL ORDINANCES OR-DINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DAVIS, STATE OF UTAH, ORDAINS AS FOLLOWS: SECTION 1. APPLICATION OF PROVISIONS OF THIS ORDINANCE. The provisions of this Ordinance shall apply to all installations of electrical conductors, fittings, devices, appliances, and fixtures, hereinafter called "electrical equipment," within or on public or private buildings and premises in Davis County outside the corporate limits of any city or town, with exception excep-tion as provided herein and with the following general exceptions: ex-ceptions: (A) The provisions of this Ordinance shall not apply to installations of electrical equipment in railway cars or to automotive equipment (B) The provisions of this Ordinance shall not apply to installations used by electricity elec-tricity supply or communication communica-tion agencies in the generation, genera-tion, transmission or distribution distribu-tion of electricity or for the operation of signals or the transmission of intelligence and located within or on buildings or premises used exclusively by such agency or on public thoroughfares used for such purposes by these agencies. (C) The provisions of this Ordinance shall apply to electrical elec-trical equipment used for radio transmission in amateur radio transmitting stations and shall apply to all electrical elec-trical equipment used for power supply to radio transmitting trans-mitting equipment, but shall not apply to other electrical equipment used for radio transmission. (D) The provisions of this Ordinance shall not apply to the installations or equipment employed by a railway utility in the exercise of its functions as a utility and located outdoors out-doors or in buildings used exclusively for that purpose. (E) The provisions of this Ordinance shall not apply to public utilities operating under the regulations of thePublic Utilities commission commis-sion on construction, repair and maintenance work incidental in-cidental to their business. (F) The provisions of this Ordinance shall not apply to industrial concerns nor their employees for electrical work performed on the premises of such industrial concerns where such indurial concerns con-cerns either employ an electrical elec-trical engineer, licensed as such by the State of Utah, or obtain Electrical Contractor's License. SECTION 2. ELECTRICAL INSPECTOR - QUALIFICATIONS QUALIFICA-TIONS AND APPOINTMENT. (A) There is hereby created the position of "Electric Inspector." In-spector." The position shall be filled by appointment made by the Board of County Commissioners. Commis-sioners. The person chosen to fill the position of Electrical Inspector shall be of good moral character and shall have a thorough knowledge of the standard materials and methods used in the installation installa-tion of electrical equipment. He shall be well versed in approved methods of installation installa-tion for safety to persons and property and shall be familiar with the rules and regulations and Statutes of the State of Utah relating to electrical work, the National Electrical Code, and he shall have had at least two years experience as an electrical inspector or in the installation of electrical equipment. (B) It shall be unlawful for the electrical Inspector or any of his assistants to engage in the business for the sale, installation ins-tallation or maintenance of electrical equipment, either directly or indirectly, and they shall have no financial interest in any concern engaged en-gaged in such business in Davis County at any time while holding such position as hereinabove provided for. (C) The National Electrical Code as prepared by the National Na-tional Electrical Contractors Association, 1975 Edition, three copies of which are on file in the Davis County Clerks Office, Farmington, Utah, be and the same hereby is adopted adopt-ed by reference and made a part hereof as though it were set out herein in full; and the said National Electrical Code is to be used as the standard for electrical installations, inspections, etc. in Davis County, except as otherwise hereinafter provided. SECTION 3. AUTHORITY OF ELECTRICAL INSPECTOR INSPEC-TOR - DUTIES OF POSITION. (A) The Davis County Electrical Elec-trical Inspector is hereby authorized and directed to enforce en-force all of the provisions of this Ordinance and to exercise his authority in a diligent manner to encourage compliance with the provisions of this Ordinance by all persons and installations installa-tions which come within the scope of this Ordinance in Davis County outside the corporate cor-porate limits of cities and towns. (B) The Electrical Inspector Inspec-tor or his duly appointed assistants, as-sistants, upon presentation ot proper credentials, shall have the right during reasonable hours to enter any building or premises in the discharge of ' his official duties, or for the purpose of making any inspection, ins-pection, re-inspection, or test of electrical equipment contained con-tained therein or its installation installa-tion in accordance with the provisions of this Ordinance. Provided, however, the right of entry into any building as hereinabove set forth shall not inciuae private aweuings actually ac-tually in use for residential purposes. Where any electrical elec-trical equipment is found by the Electrical Inspector to be dangerous to persons or property because it is defective defec-tive or is defectively installed, the firm, person or corporation corpora-tion responsible for the electrical elec-trical equipment shall be notified no-tified in writing and shall be required to place such equipment equip-ment in safe condition. If such work is not completed within fifteen days or any longer period that may be specified by the Electrical Inspector in said notice, the Electrical Inspector Ins-pector shall have the authority to disconnect or order the disconnection dis-connection of electrical service ser-vice to said electrical equipment. equip-ment. In cases of emergency, where in his judgment, it is necessary for the safety to persons or property, or where electrical equipment may interfere in-terfere with the work of the Fire Department, the Electrical Elec-trical Inspector shall have the authority to immediately disconnect dis-connect or cause disconnec tion of any electrical equipment. equip-ment. (C) The Electrical Inspector shall, upon application, issue permits for the installation or alteration of electrical equipment equip-ment and shall make inspections inspec-tions of electrical installations and equipment all as provided in this Ordinance. Complete records shall be maintained of all permits issued, all inspections inspec-tions made, and of all other official work or actions in connection with the provisions of this Ordinance. SECTION 4. STANDARDS FOR THE INSTALLATION OF ELECTRICAL EQUIPMENT. EQUIP-MENT. (A) Except as otherwise provided in Section 1, all installations ins-tallations of electrical equipment equip-ment shall be reasonably safe to persons and property and in conformity with the provisions of this Ordinance and the applicable Statutes of the State of Utah, and all rules and regulations issued by authority thereof. (B) Conformity of installations installa-tions of electrical equipment with applicable regulations as set forth in the said National Electrical Code, shall be prima facie evidence that such installations are reasonably safe to persons and property. SECTION 5. STANDARDS FOR ELECTRICAL EQUIPMENT EQUIP-MENT INSTALLED. (A) All electrical equipment installed or used shall be reasonably safe to persons and property and in conformity with the applicable Statutes of the State of Utah and with ordinances, or-dinances, rules and regulations regula-tions issued by Davis County. (B) Conformity of electrical equipment with applicable standards of Underwiters' Laboratories, Inc., shall be prima facie evidence that such equipment is reasonably safe to persons and property. (C) This Section shall not apply to equipment owned and used by an electricity supplier, communication agency in the generation, transmission or distribution of electricity or for the operation opera-tion of signals or the transmission trans-mission of intelligence. SECTION 6. APPEALS - TO BOARD OF COUNTY COMMISSIONERS. COM-MISSIONERS. (A) Any person, firm or corporation may appeal to the Board of County Commissioners Commis-sioners for the review of any decision of the Electrical Inspector Ins-pector or his assistants when such review of decision is . requested in writing. Any such request for a review of a Hpriiinn nf rhe Electrical Ins pector must be made in writing writ-ing and filed with the County Clerk within ten days after receipt of such decision. (B) Upon the filing of any such appeal the County Clerk shall present the appeal to the Board of County Commissioners Commis-sioners at its next meeting. The Board shall thereupon set a time for the hearing of said appeal and notify the appellant of the time and place thereof. Upon the Board rendering its decision, a copy thereof shall be forwarded to the Electrical Inspector. SECTION 7. PERMITS AND LICENSES REQUIRED. (A) In accordance with the provisions of this Act, no electrical elec-trical wiring or electrical equipment shall be installed within or on any building, structure, or premises publicly or privately owned, nor shall any alteration or addition ad-dition be made in any existing wiring system unless such work is done under the supervision super-vision of the holder of an appropriate Contractor's License issued by the State of Utah, and unless a permit to perform such work is first applied for and obtained from the Electrical Inspector, except as specifically exempted exempt-ed in other parts of this Ordinance Or-dinance and except that no license or permit shall be required to execute any of the classes of electrical work specified in the following paragraphs (I, 2 and 4 inclusive). (1) Minor repair work, the replacement of lamps, fuses or the connection of portable electrical equipment to suitable suita-ble permanently installed rpr pntarles. (2) The installation, alternation alter-nation or repair of electrical equipment for the operation of signals or the transmission of intelligence. (3) The installation, alteration altera-tion or repair of electrical equipment intended by or for an electrical supplier or communication com-munication agency for the use of such agency in the genera-lion, genera-lion, transmission, distribution distribu-tion or metering of electricity. (4) Any work involved in the manufacturing, testing, servicing, ser-vicing, altering or repairing of electrical equipment or apparatus, ap-paratus, except that this exemption shall not include any permanent wiring other than that required for testing purposes. (B) The Electrical Inspector Inspec-tor may issue to an individual a special Owner's Permit authorizing said individual to install, alter, change or repair electrical wiring or equipment equip-ment in, on, or about a single family dwelling owned by the . individual and in which he resides or intends to reside, but not elsewhere; provided however, that no electrical work authorized under such special Owner's Permit shall be done except personally by the owner to whom the permit is issued. Such owner shall not be required to have an Electrical Elec-trical Contractor's License but shall be subject to all of the provisions of this Ordinance. Or-dinance. The Electrical Inspector, Ins-pector, in cases of extreme hardship, shall be empowered to waive the regulations regarding personal performance perfor-mance of the work by the owner himself if such action is deemed in the public interest. In any case, all work performed per-formed under a special Owner's Permit shall be subject sub-ject to the same standards of safety and workmanship established es-tablished by this ordinance and shall be required to pass inspection by the Electrical Inspector. Any violation of the provisions of this Ordinance by the holder of a special Owner's Permit or failure of such permit holder to install electrical wiring or equipment equip-ment in accordance with this Ordinance shall be cause for cancellation of this Special Owner's Permit and the holder thereof shall be liable for the penalty hereinafter provided for violation of this Ordinance. (C) Permits for electrical work shall be issued by the Electrical Inspector. Application Applica-tion for such permits shall be made on forms furnished by the Electrical Inspector. SECTION 8. FEES FOR ELECTRICAL PERMITS. Fees for electrical permits shall be as follows: (A) Minimum fee for any inspection is $10. (B) Fees for single family and duplex residences shall be one cent per foot. (C) Fees for multiple dwellings, residential, shall be $7.00 per unit, up to and including ten units, and $4.00 per unit for all over ten units. (D) For remodeling existing exist-ing residential occupancies or houses moved to new location, including temporary mobile homes, the fee shall be $10.00, plus one cent per square foot over 1,000 square feet. (E) For business, commercial, commer-cial, industrial, and other oc-cupancies oc-cupancies other than residen-tial, residen-tial, new work, temporary" service alterations, or repairs of 600-volt capacity or less of service equipment, fees shall be computed in accordance with the following: 100-am-pere service switches or conductor con-ductor rating, $5.00, plus each additional 100 amperes or fraction thereof, shall be $2.50. Branch circuit charges shall be per breaker or fuse protection protec-tion rating: 0-30 amps $.50 31 -60 amps 1.50 61 -100 amps 2.00 Each additional 100 amperes am-peres or fraction thereof, $1.00; over 600 volts, minimum base fee is $25.00. (F) All motor driven or permanently per-manently connected devices or appliances such as air conditioners, con-ditioners, furnaces, etc., shall be $5.00 when the combined fees for all phases beat or exceed ex-ceed $10.00 minimum; otherwise other-wise $10.00 minimum applies. (G) The fee for electrical permits for temporary metering meter-ing and service facilities for residential construction in less than 100 amperes ,. capacity shall be $7.50. SECTION 9. SPECIAL WIRING METHODS REQUIRED. (A) In order to safeguard life and property, the Board of County Commissioners shall have the authority by resolution resolu-tion to require that certain wiring methods, such as enclosed wiring systems, shall be installed in certain locations; and that certain wiring methods, such as open wiring or other methods of wiring shall not be permitted in those locations. The Electrical Elec-trical Inspector shall be required to enforce all such rules and regulations, which shall thereafter be considered as a part of this Ordinance. (B) Enclosed wiring and approved metal raceways shall be required in any building build-ing open to the public such as churches, schools, hospitals, hotels, motels, stores, theaters, commercial buildings, build-ings, storage garages, industrial indus-trial and manufacturing building or warehouses, and any building containing multiple mul-tiple dwelling occupancies of five or more units located any place in Davis County outside the corporate limits of cities anrt towns. (C) The Electrical Inspector shall have authority to authorize the useof any wiring method or the installation of any electrical equipment or material by special permission permis-sion when corrosive or moisture mois-ture conditions or structural details make the use of wiring methods, equipment or materials specified by this Ordinance impractical. Such special permission shall be for the specific use only and shall 'not establish any precedent for future installations. (D) The following wiring methods shall not be used in any location where enclosed wiring is required by this Ordinance Or-dinance or by special ruling of the Board of County Commissioners: Commis-sioners: (1) Open wiring on insulators. insula-tors. (2) Concealed knob and lube wiring. (3) Non-metallic sheathed (4) Armored cable of the AC or ACT types. (5) Service entrance cable. (6) Non-metallic waterproof wiring. (7) Non-metallic surface extensions. (E) Short lengths of armored ar-mored cable types AC and ACT not exceeding 24 feet in length may be used without special permission for motor connections or for fishing in inaccessible places. ...,, SECTION 10. MINIMUM WIRING REQUIREMENTS. (A) In order to provide for safety from fire hazard due to electrical overload, the following minimum standards shall apply to any and all electrical wiring or equipment equip-ment installed at any location in Davis County outside of the corporate limits of cities and towns, to wit: (a) Service entrance. The service head for overhead service ser-vice entrance shall be located at the first point of attachment of service drop to the building. All service entrance conductors conduc-tors shall be installed in rigid metal conduit, electrical metallic me-tallic tubing, or other approved metal raceway. (2) Service Entrance for Residential Occupancy. For single family dwellings of 500 square feet to 1500 square feet area the service entrance conductor con-ductor shall be rated at not less than 95 amperes per conductor con-ductor and shall be installed in approved metal raceway of not less than 1 - Vi incn minimum I.D. using an approved 100-ampere meter socket. Fon single family dwellings of over 1500 square feet area the service entrance conductor shall be rated at not less than 110-amperes per conductor and shall be installed ins-talled in approved metal raceways of not less than 1 - V2 inch minimum I.D. using an approved 200-ampere meter socket. Load meters shall have mains at least as large as the service conductors. If the computed load in any residence shall indicate use of a larger service entrance than specified herein, by reference to the National Electrical Code Tables, then the larger sizes shall be installed in conformance confor-mance with the table, with the requirements of the National Electrical Code. (3) Minimum Safe Requirements - Residential Occupancy. All wiring in residences shall be at least as heavy as No. 12 wire. (4) Branch Circuits -Residential Occupancy. (i) A branch circuit terminating ter-minating in an approved receptacle shall be installed for an electrical range in each dwelling occupancy. (ii) Two or more 20-ampere branch circuits shall be provided for receptacle outlets (other than clock outlets) for the appliance load in the kitchen, laundry, pantry, dining room, hall ways and breakfast room in each dwelling occupancy. (iii) At least two spare circuits cir-cuits with a minimum of 20-amperes 20-amperes capacity each shall be provided in the load center of each dwelling occupancy for the future use of appliances, etc. SECTION KU. INSPECTION INSPEC-TION AND CERT1F1CA1 bS. (A) Upon the completion of any installation of electrical equipment or wiring which has been made under a permit, per-mit, it shall be the duty of the person, firm or corporation making the installation to notify no-tify the Electrical Inspector, who shall inspect the installation ins-tallation within 24 hours, exclusive of Saturdays, Sundays, Sun-days, and holidays, of the time such notice is given, or as soon thereafter as practical. (B) Where the Electrical Inspector finds the installation installa-tion to be in conformity with provisions of this Ordinance, he shall issue to the person, firm or corporation making the installation a Certificate of Approval with a duplicate copy for delivery to the owner, authorizing the use of the installation and connection connec-tion to the supply of electricity, elec-tricity, and shall send written notice of such authorization to the agency supplying the electrical service. (C) When a Certificate of Approval is issued authorizing authoriz-ing the connection and use of a temporary installation or temporary connection to the permanent service for the temporary use of such service, ser-vice, such certificate shall be issued to expire at a time to be stated therein and shall be revocable by the Electrical Inspector for cause. (D) When any electrical equipment or wiring is to be hidden from view by the permanent per-manent placement of parts of the building, the person, firm or corporation installing the equipment shall notify the Electrical Inspector and such equipment or wiring shall not be concealed until it has been inspected and approved by the Electrical Inspector or until 24 hours, exclusive of Saturdays, Sundays and holidays, shall have elapsed from the time of such notification, no-tification, provided that on large installations where the concealment of equipment ' and wiring proceeds continuously, con-tinuously, the person, firm, or corporation installing the equipment or wiring shall give the Electrical Inspector due notice and inspection shall be made periodically during the progress of the work. Final inspection shall be made after the completion of all work and before a Certificate Cer-tificate of Approval is issued on any job. (E) If upon inspection any installation is not found to be fully in conformity with the provisions of this Ordinance, the Electrical Inspector shali at once forward to the person, firm or corporation making the installation a written notice no-tice stating the defects which have been found to exist. SECTION 12. CONNECTION CONNEC-TION TO INSTALLATIONS. It shall be unlawful for any person,-firm or corporation to make connection from a supply sup-ply of electricity or to supply electricity to any electrical equipment or wiring, for which installation a permit is required, or which has been disconnected or ordered to be disconnected by the Electrical Elec-trical Inspector, until a Certificate Cer-tificate of Approval has been issued by the Electrical inspector authorizing the connection and use of such equipment or wiring. SECTION 13. All ordinances or-dinances in conflict with this Ordinance are hereby repealed. SECTION 14. This Ordinance Or-dinance shall become valid and effective fifteen days after its passage or upon the date of its publication in a newspaper having general circulation in Davis County, or whichever date is later.
