(2) "Public Place," for the purpose of this section means any place to which the public or a substantial group of public has access and includes but is not limited to streets, highways high-ways and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities facili-ties and shops. (3) Disorderly conduct is a Class C misdemeanor if the offense continues after a request by a person to desist and is punishable by a fine in any sum not exceeding ex-ceeding $299.00 or by imprisonment in the city or county jail for a period not longer than 90 days or by both such fine and imprisonment. (4) Disorderly conduct otherwise other-wise as set forth in Subsection Sub-section (3), next preceding, preced-ing, is an infraction and is punishable by a fine in any amount not exceeding $299.00. Section 2. Conflict. All ordinances, or-dinances, resolutions, ana orders or parts thereof in conflict with the provisions of this ordinance are, to the extent ex-tent of such conflict, hereby repealed provided that such repeal shall not effect any act done or right accrued, and penalty incurred, any suit, prosecution or proceeding pending. Section 3. This Ordinance To Take Effect Upon First Publication In the opinion of the City Council, it is necessary to the peace, health and safety of the inhabitants of Bountiful, that this ordinance take effect immediately. im-mediately.
