Show f- HUGO D, BENISCH BROUGHT BACK AND PLACED UNDER A BOND OF FIVE THOUSAND Hugo D. Benisch, of Denver and New York, a chemicals salesman, charged with swindling Samuel H. Newhousc of Salt Lake out of 52,600, the alleged crime being alleged as committed In W cber county, about August Au-gust 1, 1916, who arrived last night about 9 o'clock, accompanied by former for-mer Sheriff Thomas A. DeVlne and George W. Leatham. today was arraigned ar-raigned before Municipal Judge George S. Barker and his bail-bond for appearance at his preliminary trial, January 11, at 10 o'clock, was fixed at $5,000, which was supplied by the National Surety company of New York. Benisch seemed greatly relieved nlirn the ?5,ii00 bond was agreed upon, for be had arranged for bail in this amount before leaving New York. Undecided as to Plea. Immediately after he left the courtroom court-room Benisch was asked bv n Standard Stand-ard reporter whether he desired to relate re-late his "tale of woe." He asked that the interview be postponed. "You'll plead not guilty to the charge, of course,'' said the reporter. Benisch laughed and replied: "I don't know, really, till I've consulted with lawyers." Returns Voluntarily. The accused man was represented by Attorneys J. A. Howell and C. A. Boyd, each of who pleaded that the bond be fixed at $5,0uu. Mr. Howell stated he was informed by former Sheriff DeVine that Benisch did not fight extradition, but asked to bo rc-eased rc-eased on bail in New York, which I was done, the amount being $5,000. He said Benisch returned voluntarily I and quoted from a brief on the subject sub-ject of bonds prepared by Attorneys 1 Chez and Stine and used In the Martin blackmailing case to show the bond should not be excessive. The Swindle, as Alleged. Benisch is charged with felony in an j alleged representation to Samuel H. Newhouse, the Salt Lake capitalist, ; that he had bought a carload of chem- j icals for $2,850; had taken orders for the sale of the chemicals amounting to : $6,400; that there remained unsold one-third of the carload valued at $1,-000; $1,-000; that he proposed to organize a chemical company and give I. H. New-house New-house of Denver a half interest, and that on these representations, alleged to be false, he obtained a check for $2,600. The complaint was signed for former for-mer Deputy Sheriff C. H. Ellsworth. Benisch is well known In Utah and I Colorado. He has a wife and child in New York. He said he was courteously courteous-ly treated by Messrs. DeVine and Leatham in New York and on the way to Ogden. The alleged swindler is a New Yorker of the Wall street tvpe, a big. bluff, aggressive man with an impres-sive impres-sive "front " |
