Show 'PULLED OUT HER FALSE TEETH The suit for separate mnnlntennnce of larji" Baxter ,vs.- William Baxter was aga'ln taken up for hearing this morning. This time it Is being tried by Judge Howell, Judge Harris presiding pre-siding at the previous hearing. Tho case was called some time ago in Judge Harris' division of the district dis-trict court, the defendant not appearing. appear-ing. E. parte testimony was taken in the case, Mrs. Baxter relating from the witness chair the cruelties and Injustices In-justices that had been heuped upon her by her husband during the past few years, and upon that testimony the court granted the plaintiff the relief re-lief sought. The community property of the parties was awarded to Mrs. Baxter and it was ordered that she bo given Immediate possession. Subsequently, however, it was represented repre-sented hy the defendant that ho had noa had due notice of tho hearing I nnd, therefore, was not on hand to put in his defense. Upon this showing show-ing tho previous Judgment was set aside, a now trial ordered and tho case transferred to Judge Howell's court Mrs. Baxter this morning reiterated her story of tho previous trial, jelling of the manner in which she and the children had been treated by Mr.Box-ter. Mr.Box-ter. Sho dramatically pofnted her finger at Mrs. Susana Duflln who sat In the court room and advised the court that she was the cause of nil hto trouble between herself and Mr. Baxter. "I havo tried many times to tell this woman to her face what sho has done toward me, but never could get to talk to her", said Mrs. Baxter," but I meet her face to face in this court room now and I want to tell her and the court what sho has done." Mrs. Baxter said that her husband had -heon koeplng company with Mrs. Duflln for some time past and that he hrd neglected herself and the children chil-dren to make things pleasant for the woman She told of Mr. Baxter taking tak-ing Mrs Duflln to the canyon resorts for entertainment and leaving her at homo to look after tho children, who were barefooted often times and without with-out other propor clothing. The witness wit-ness stated that her husband has heen living at Mrs. Duffin's homo In Salt Lake for the past seven years and that, In order to see him, sho, on one occasion, walked from Ogden to Fnrmlngton, carrying one of the children, chil-dren, where a friond gave h9r money to pay her fare the rest of the way to Salt Lake. She said that after sho arrived at the state capital she washed wash-ed tho children's' faces with ditch water, because he complained that thev were dusty and unclean. Mrs. Baxter a!s,o said that Mr. Baxter Bax-ter had driven her from their homo and compelled her to remain in the field all one nlghL She slept on the ground. On another occasion Mr. Baxter Bax-ter drove one of the children from the home and than when the mother interfcrred, he grabbed her by the mouth and wrenc)ied her false teeth from their position and so lacerated her gums and mpiith that blood flowed. flow-ed. Sho told of her ill-treatment In Ogden canyon July rourth last year when Mr. Baxter whipped her and so aggravated her that she ran into the river nnd came near being drowned In answer, Mr.J3axter denies the alleged al-leged acts of cruelty and failure to provide and in a cross-complaint has a few things to say against Mrs. Baxter Bax-ter He says that Mrs. Baxter has been cruel to him and has misused hlni In many ways Ho states that upon one occasion Mrs Baxter stripped strip-ped her skirt off and whipped him over the head with It and otherwise acted In a rediculous manner on the public highway. . no |
