Mellen Secures Temporary Injunction Against City. j Letting of the contract to pave Eighth East and Fourth South streets to Par-rott Par-rott Brothers was temporarily blocked yesterday when Joseph W. Mellen, rival contractor,, obtained from' Judge T. D. Lewis of the Third district court a temporary tem-porary restraining order against the mayor and commissioners oi Salt !pake. fcniit was filed by Mellen to obtain permanent injunction against the letting let-ting of the contract on the grouud that-plans that-plans and specifications were not accessible acces-sible for bidding contractors as advertised adver-tised in the city's published notice of intention to pave. The complainant sets out that no specifications were available before June S and that bidding closed on the project on June 13. Efforts to obtain copies of specifications before June 8, he alleges, al-leges, were unavailing, because of which, he maintains, fair opportunity was not afforded all contractors to figure on the work. "The restraining order issued is returnable return-able Monday morning, June 26, at 10 o'clock. Decision to award Parrot t Brothers the contract on a low bid of $01,712.22 was made by the city commission Wednesday morning. J. W. Mellen was the next lowest bidder on the work. - In his complaint Mr. Mellen sets out that the specifications of the proposed improvement should, according to law and according to advertisement, have been accessible o all bidding contractors contrac-tors for at least twenty days before the date of closing the bids. Alleging that such was not the case, he asks for a permanent court injunction against the entering into signed contracts by the city commissioners and Parrott Brothers Broth-ers as a. result of the award made upon the bids submitted.
