Show FORCE ISSUANCE OF STWIFICSTE Secretary of State Refuses to Give Concern Right to Do Business in State. Petition for a writ of mandamus forcing David Mattson, secretary of state, to issuo a certificate to the National Na-tional Mercantile company of Vancouver, Vancou-ver, B. C.f allowing it to carry on its business in Utah, was filed in tho district dis-trict court 3resterda3r. An altornative writ returnable February 20 was issued. is-sued. Tho socretary of state refused to accept ac-cept and file the articles of incorporation incorpora-tion of the company and issue tho .necessary .nec-essary certificate on advice of the attorney at-torney general. This refusal was based on tho ground that tho National Mercantile Mer-cantile company is a building and loan association, and consequently must file the statutory amount of security with the secrotary of state beforo doing business. Tho company declares it is in no sense a building and loan association associa-tion and has rofused to file tho security securi-ty required. D. 0. Willey, attornoy for the company, com-pany, explained yesterday that the company deals in loan contracts, which merely involve tho loaning of monoy to individuals when certain requirements and agreements aro met. The fact that tho money is usually loaned for building build-ing purposes does not necessarily mean that tho company is a building and loan association, ho declared. |
