The ordinance to be proposed by Commissioner Com-missioner Wclla follows: A'N ORDINANCE Providing for smoke Inspection In -Salt Itko City. Be It ordained by tho board of commissioners com-missioners of -Salt Lake City, TTraJi: Section 1. There Is hereby established a bureau of smoke Inspection, the head of which shall be known as tho smoko Inspector. Section 2. Tho smoko Inspector shall be appointed by the commissioner of public safety by and with the advice and approval ap-proval of tho board of commissi oners. Section 3. Tho person so appointed shall be a mechanical engineer, qualified by technical training and experience In the theory and practice of the construction construc-tion and operation of steam boilers and furnaces, and also In the theory and practice prac-tice of smoke abatement and prevention. Section The smoko Inspector, 'before entering upon the duties of Ills ofllce, shall execute a bond to Salt iLake City in tho sum of 53000, with sureties to bo approved by the commission conditioned upon the faithful poriormanco of tho duties du-ties of his office. Section fl. The salary of the smoke Inspector In-spector shall lie $tS00 per annum, payable monthly, as aro the salaries of other city officers. Section 0. There Is hereby orcatcd the office of chief assistant smoko Inspector, who shall bo appointed by the smoko Inspector In-spector subjoct to the confirmation of tho board of commissioners. Section 7. The qualifications of tho chief assistant smoke Inspector shall bo the same as the qualifications heroin provided pro-vided for the smoke inspector. Section S. The chief assistant smoko inspector shall, before entering upon tho duties of his office, execute a bond to Salt Lako City, In the sum of $2000, with sureties to be approved by tho. commission, commis-sion, conditioned upon tho faithful performance per-formance of the duties of his office. Section 9. Tho salary of the chief assistant as-sistant smoke Inspector shall bo 1500 per annum, payable monthly, as are tho salaries sal-aries of other city officers. Section 10. There shall bo as many deputy smok'o Inspectors as shall bo provided pro-vided for by the city commission; their compensation shall be fixed by tho city commission, and they shall bo appointed by tho smoke Inspector subject to confirmation con-firmation by the board of commissioners. Section 11. There shall bo as many clerks and stenographers assigned to this bureau as shall bo provided by the city commission; their compensation shall bo fixed by the clty commission and they shall bo appointed by the smoke inspector inspec-tor subject to confirmation by the board of commissioners. Section 12. No new plants or any reconstruction re-construction or repair of old plants for producing power and heat, or either of them, or any new chimney connected with a. steam plant except In prlvato residences, shall be erected, reconstructed, repaired or maintained In the city until plans and specifications of the same have boon filed in the office of and approved by the smoke inspector and a permit Issued by him for such erection, reconstruction, repair or maintenance. Plans and specifications to be filed with the smoko inspector shall show the amount and kind of work, the manner of construction", reconstruction or repair and. the amount of heating to be done by such plant and all appurtunances thereto, Including In-cluding all provisions made for the pur-poso pur-poso of securing complete combustion of the fuel to be used and for the purpose of preventing smoke; said plans and specifications sliall also contain a statement state-ment of the kind of fuel proposed to be used, and said plans and specifications shall also show what provision Is mado In the room or apartment In which such plant shall bu located for ventilation sufficient suf-ficient for tho proper comfort of tho operator. op-erator. Upon the approval of such plans and specifications, a duplicate set of which shall be left on file in said office,, and upon the payment of fees hereinafter provided, tho smoke Inspector shall Issuo a permit for the repair, reconstruction, frectlon or maintenance of such plant. As soon as the smoko Inspector has examined ex-amined the plans .and specifications submitted sub-mitted and has issued a permit as above provided, he shall then notify the building build-ing Inspector to see that the execution of the work permitted is carried out in conformity con-formity with the plans and specifications, specifica-tions, with special reference lo tho amount of space used, tho slzo and construction con-struction of the chimney used, tho provisions pro-visions for the prevention of smoke, and the provisions for ventilation, and maintaining main-taining the proper temperature in the engine and boiler room. Section 13. Tt shall bo unlawful for any person to use any new, repaired or reconstructed plant for the production and generation of heat and power, or either of thorn, except in rrlvato residences, resi-dences, until he shall have first procured a certificate from the smoke Inspector that the plant Is so constructed that it will do the work required and that It can he so operated that no dense or thick, black or gray smoke or cinders will bn emitted from tho chimney connected con-nected with the furnace or firebox. Section 11. No owner, agent or lesseo shall alter or repair any chimney or any old furnace or device, except In private residences, which alteration, chango or installation may affect the method or efficiency of Bmoke prevention without first submitting; plans and specifications to the smoko inspector and securing a permit therefor; provided, however, that minor necessary or emergency repairs which do not increase tho capacity of such plant or which do not involve any substantial alteration In structure and which do not involve any alteration In tho method or efficiency of smoke prevention, pre-vention, may be mado -by or under tho engineer in charge of said plant without a permit- Any person who shall violate this section shall be liable to a fine of "S2.") for each day upon which he shall proseculo such alteration, chango or Installation In-stallation without a permit, and each tiny h violation snail constitute a separate sepa-rate offense. Section 17. Prosecution for all violations viola-tions of this ordlnanco shall bo Instituted by tho smoko Inspector and shall be prosecuted by tho city attorney In tho name of Salt Lake City. The Issuance and delivery by tho smoke Inspector of any permit or certificate for tho construction or reconstruction, or any pormlt for tho alteration or repair of any plant or chimney connected with a plant, shall not be held to exempt any person or corporation to whom any such permit has been Issued or delivered, or who is In possession of any such permit, from prosecution on account of the emission or issuance of denso or thick black or gray smoko or cinders, caused or permitted per-mitted by any such person or corporation. corpora-tion. Section IS. The city shall provide such Instruments, books, papors and equipment equip-ment as shall be necessary for tho proper performance of the duties of the members mem-bers of tho bureau. Tho smoko Inspector shall havo chargo of such Instruments, boolcs, papers and equipment, and shall deliver the same to his successor In office. Section 19. Tho smoko Inspector shall cause to bo kept la his office a complete record of all plans submitted and of all permits Issued and of all examinations of plants made by members of the bureau bu-reau and also of all certificates issued. Section 20. The smoke Inspector siiall make a report of the work of this bureau bu-reau to tho city commission annually, on or before tho first day of January, and at other times as often as required by tho city commission. Section 1!L It shall be unlawful for any person acting on behalf of tho city under tho provisions of this ordinance, to take or receive any monoy or any valuable tiling for tho purposo of deceiving deceiv-ing or defrauding any person or persons, or for tho purposo of favoring any person per-son or persons, or lo recommend the issuanco of any certificate of Inspection without having at tho time stated In said certificate thoroughly examined the furnace, fur-nace, device or apparatus mentioned therein. Any person violating the provisions of this section shall, upon conviction thereof, there-of, bo punished by a fine in any sum not exceeding $100, or by Imprisonment in tho city Jail for a perldd not exceeding sixty days. The court may. In imposing this fine, enter as part of tho Judgment that in default of tho paymont of tho fino tho defendant may bo imprisoned in the city jail for a period of not exceeding exceed-ing sixty days. Section 22. All ordinances and parts of ordinances and resolutions and parts of resolutions In conflict with this ordinance, ordi-nance, aro hereby repealed to tho extent of such conflict. Section 23. This ordinance shall take effect upon Its first publication. |
