Show ANK fXAMmtR lAllfR TESTIFIED AT THE TRIAL 05 BACON YESTEBBAY Pointed Out Instances of Irregularities Irregular-ities In the Books of the late American National BankCourt Adjourned Early to Accommodate the Jury The trial of James H Bacon yesterday yester-day was voted to an examination of James B Lazier the national bank examiner who made official reports to the comptroller on the condition of the late American National bank of which the defendant was president Mr Lazier La-zier detailed a number of entries on the books which he claimed to be fraudulent fraudu-lent and erroneous On account of the delay of Juryman Croft of Farmington in arriving court was not in session until about 1030 and an adjournment was taken for the day at 1 oclock as a favor to one of the jurymen who had urgent business to attend to The first Question considered at the morning session was as to whether the copy of the letter from the comptroller tothe bank officials procured by J B Edmunds should be admitted in evidence evi-dence The court ruled that the letter could not be introduced as the original from which the copy had been obtained was secured by unreasonable seizure Mr Lazier was on the stand during the rest of the session His testimony was as to the condition of the books at certain periods whe he had made reports He called attention to an entry en-try of S50000 to the credit of the Hot Sulphur Springs Bath company and said that cash was debited on the same date with a similar amount This remained re-mained on the books until May 1893 when there were two entries crediting and deducting 25000 of this During this time two reports to the comptroller were made which showed a raise in the percentage of cash reserve although the liabilities were increased in a corresponding cor-responding sum Mr Lazier also testified to a similar transaction shown on the books in the name of J Harrison for 50000 Court then adjourned until 10 oclock this morning |
