Show RESOLUTION NO. 82-13 A RESOLUTION DECLARING DEC-LARING THE INTENTION OF THE CITY COUNCILTO ESTABLISH A SERVICE DISTRICT IN THE NORTH PORTION OF CENTERVIL-LE CENTERVIL-LE CITY. Whereas, Title 11, Chapter 23, Utah Code Annotated 1953, as amended, known as the "Utah Special Service District Dis-trict Act", authorizes the establishment of municipal service districts; and WHEREAS, said statute provides, among other things, that the Legislature recognizes the duty of cities as instruments instru-ments of State Government to meet adequately the needs of incorporated areas, and also recognizes that such areas should pay for the extended services provided; and, WHEREAS, the City Council Coun-cil has found and hereby declares de-clares that the public health, convenience, and necessity require re-quire the establishment of a Special Service District within the City for the purpose of providing pro-viding the services hereinafter set forth; and WHEREAS, in the interest of Centerville City and the inhabitants in-habitants thereof, the City Council proposes, and hereby declares its intention to create a municipal service area for the purpose of acquiring or constructing con-structing and thereafter operating ope-rating and maintaining a pressure press-ure irrigation water system in the area of North Centerville hereinafter particularly described; de-scribed; NOW THEREFORE, BE ,IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF CENTERVILLE CENTERVIL-LE , DAVIS COUNTY, UTAH, AS FOLLOWS: 1 . That pursuant to Chapter 23, Title 1 1 , Utah Code Annotated Anno-tated 1953, as amended, known as the "Utah Special Service District Act", a City service area be established and known as North Centerville Service District for the purpose pur-pose of providing the following services to the hereinafter defined de-fined incorporated area of Centerville City, Davis County, Coun-ty, Utah, to-wit: Acquisition andor construction con-struction of a secondary water system to store, conserve, con-serve, distribute andor furnish, fur-nish, under pressure where practical, untreated water for irrigation and domestic purposes, excluding, however, culinary uses, within the northern portion of the City as hereinafter described, all as contemplated contem-plated by said Chapter 23, Title 11. 2. That upon establishment of the North Centerville Service Ser-vice District, a tax sufficient to pay for said water storage and distribution system, including the acquisition of- water and water rights as necessary, be annually levied upon all tax able properly within said North Centerville Service District, Dis-trict, and which tax shall be levied in accordance with law. T hat in addition to or in lieu of taxes, fees and charges may be imposed. 3. That a public hearing shall be held on the establishment of said North Centerville Service District as required by law, in-the in-the Jenny P. Stewart School, 1125 N. Main St., Centerville, Utah, at the hour of 7:00 P.M. on T uesday, February 5, 1983, before the City Council of Centerville, Cen-terville, Davis County, Utah, which date of hearing shall be not less than twenty-one days nor more than thirty-live days after the first publication of notice of said hearing. 4. That at said hearing all interested persons who desire shall be heard and may, either prior to or at said hearing, orally oral-ly or in writing, protest the establishment of said North Centerville Service District, or the acquisition of an irrigation water storage and distribution system witn necessary water rights; provided, however, that if persons constituting and consisting of over 50 percent of the qualified voters of the area proposed to be included within the Service District file written protests within fifteen days after af-ter the conclusion of the hearing hear-ing against the establishment of said Special Service District, Dis-trict, or against the specified type or types of extended service ser-vice within said Service District, Dis-trict, the City Council shall, in the former instance, abandon the proposed establishment of the Special Service District, and in the latter instance, eliminate eli-minate those types of services objected to from the Resolution Resolu-tion finally establishing the Service District. 5. That the area to be included in-cluded within the North Centerville Cen-terville Service District is that area lying between the East right-of-way line of 1-15 and the East City limits, and between be-tween Lund Lane as extended on the North and Chase Lane on the South, but excluding any portion or portions of said area presently receiving pressure press-ure irrigation water service from the Weber Basin Water Conservancy District or the Centerville Deuel Creek Irrigation Irri-gation Company. 6. That the City Recorder is hereby authorized to publish a certified copy of this Resolution Resolu-tion pertaining to said North Centerville Service District in the Davis County Clipper on the 26th day of January and on the 2nd and the 9th days of February, 1983, said newspaper newspap-er having general circulation within the City of Centerville, Utah.
