Section 5. The City Recorder is hereby directed to give notice no-tice of the intention of the City Council to make the proposed improvements and to levy assessments as-sessments to pay all or a part of the cost thereof, which notice no-tice shall be published in the Davis County Clipper, a newspaper news-paper published in, and of general circulation in the City of Bountiful, Utah, four (4) times, once during each week for four (4) consecutive weeks, the last publication to be not less than five (5) nor more than twenty (20) days prior to the time designated in such notice as the last day for the filing of protests. In addition, ad-dition, not later than ten (10) days after the first publication of such notice, the notice shall be mailed, postage prepaid (i) addressed to each owner ot property to be assessed within the Special Improvement District Dis-trict at the last known address of such owner using for such purpose the names and addresses appearing on the last completed real property assessment rolls of the County in which the property is located; locat-ed; and (ii) addressed to "Owner" at the street number of each piece of improved property to be assessed. Said notice shall be in substantially sub-stantially the following form : NOTICE OF INTENTION TO CREATE SPECIAL IMPROVEMENT DISTRICT NO. 10 IN BOUNTIFUL, DAVIS COUNTY, UTAH PUBLIC NOTICE IS HEREBY GIVEN that on the 7th day of May, 1975, the Mayor and City Council of Bountiful, Davis County, Utah, passed and adopted a resolution declaring its intention inten-tion to cieate in said City a Special Improvement District No. 10 of Bountiful, Davis County, Utah. NOTICE IS FURTHER GIVEN that prior to adopting said Resolution, the City Council had, by Resolution adopted on March 19, 1975, declared its intention to create such proposed District and had published a notice of such intention and mailed such notice to owners of property within the proposed District and had met and heard protests and objections with respect to such District on April 23, 1975, at which time the City Council adjourned ad-journed said meeting to consider con-sider such protests and objections ob-jections (which, in total, represented less than two-thirds two-thirds of the front footage of the property to be assessed) ; that following such meeting the City Council determined that it was adviseable to rescind, res-cind, cancel and repeal the said resolution adopted on March 19, 1975 (and did rescind, res-cind, cancel and repeal the same by a resolution adopted on May 7, 1975) and to adopt the said May 7,-1975 Resolution Resolu-tion declaring its intention to create such District, to publish and mail notice of such intention as required by law and to meet and hear protests and objections with respect to such District filed in the manner and within the time specified hereafter in this Notice. NOTICE IS HEREBY GIVEN by the City Council of Bountiful, Utah, of its intention inten-tion to make the hereinafter described improvements within the said Special Improvement District and of the further intention of said Council to levy assessments as provided by the laws of Utah on the property lying within said District benefited by the making of such improvements, according to the benefits to be derived by such property, to pay all or part of the cost of the said improvements. The improvements proposed to be made are to consist of necessary grading and constructing or reconstructing recon-structing curbs, gutters and sidewalks, appurtenant drainage facilities, driveways, waterways, drainage piping, inlet structures, struc-tures, corner intersections, and other appurtenant facilities facili-ties and works and to remove trees and other non-conforming improvements and to excavate, ex-cavate, fill, grade, drain and to do all other miscellaneous vork necessary to complete the improvements in a proper workmanlike manner according accord-ing to plans, profiles and specifications on file in the Office of the City Recorder of Bountiful, Utah. k?ATI0N 0F PROPOSED IMPROVEMENTS The names of the streets and parts thereof to be thus improved are as follows: 500 West Street: Construct sidewalk, curb and gutter and other appurtenant work along the East and West sides of 50C West Street from 1000 North Street to 1500 South Street, except no sidewalk, curb and gutter to be constructed in the areas as follows: Along the East side from a point 210 ft. ESTIMATED COST As determined by the City Engineer the total estimated cost of all improvements, as determined by the City Engineer, En-gineer, is $212,000.00, of which the city s portion is $i,tuu.uu and the remainder in the amount of $210,300.00 is to be paid by assessments to be levied on all blocks, lots, parts of blocks and lots, tracts or parcels of property bounding, bound-ing, abutting upon, or adjacent ad-jacent to the improvements or which may be affected or specially benefited by the improvements to the extent of ' the benefits to such property by reason of Hhe improvements. Assessments shall be made according to the frontage of the property on the streets or alleys to be improved. The estimated cost per front foot of the improvements of the property to be assessed is as follows: Sidewalk - $3.15 per front foot. 24" curb and gutter - $3.75 per front foot. 30" curb and gutter - $4.70 per front foot. All curb and gutter to be installed as indicated in-dicated above on U.S. Highway High-way 91 and 500 West Street (the same being state highway) high-way) will be 30"; all other curb and gutter to be installed as indicated above on other streets will be 24". The estimated cost per front foot stated above does not include the cost of driveways which will be installed in-stalled as a part of the improvements only at the option op-tion and request of the property owner, made in writing to the City Recorder before construction of such improvements is commenced. com-menced. If so requested and installed, the cost shall be assessed against the property benefited, in addition to the assessment for other improvements. Driveways are estimated to cost $1.50 per square foot for driveways 6 inches thick. All non-conforming existing improvements such as lawns, sprinkling systems, rock gardens, gar-dens, trees, driveways, curbs, sidewalks, etc., which are located within the area to be improved shall be removed by the property owners at their expense prior to construction cons-truction of the improvements, and if not so removed, will be removed by the contractor as part of the project and the cost thereof may be assessed against the property benefited benefit-ed in addition to the assessment assess-ment for other purposes. There shall be an allowance made for corner lots so that such lots are not assessed at the full rate on both streets. PAYMENT OF ASSESSMENTS The assessments may be paid by the property owners in ten (10) annual installments install-ments with interest on the unpaid balance at a rate or rates not to exceed ten percent per-cent per annum as fixed by the City Council, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment as-sessment becomes effective. In addition, all unpaid assessments as-sessments may be payable after such fifteen (15) day period prior to their due dates upon such terms and conditions condi-tions as the City Council may specify in the ordinance levying levy-ing the assessments, in accordance ac-cordance with Section 10-16-21(3), Utah Code Annotated, Anno-tated, 1953. Default in the payment of any installment of an assessment shall cause the whole of the unpaid principal and interest to become due and payable immediately and the whole amount of the unpaid un-paid principal shall thereafter draw interest at the rate of ten percent ( 10) per annum until paid, but at any time prior to the date of sale or foreclosure of the property against which Jhe defaulted assessment is levied, the owner will be able to pay the amount of all unpaid un-paid installments past due, with interest at the rate of ten percent (10) per annum to the date of payment on the delinquent installments, and all approved costs, and shall thereupon be restored to the right thereafter to pay in ins- tallments in the same manner as if default had not occurred. A map of the proposed District Dis-trict and the plans, profiles and specifications of the proposed improvements are on file in the Office of the City Recorder, and all persons interested are hereby referred to the same for further information in regard to said improvements and said Special Improvement District. TIME FOR FILING PROTESTS Any person who is the owner of property to be assessed as-sessed in the Special Improvement District described in the Notice of Intention In-tention shall have the right to file in writing a protest to the creation of the Special Improvement District or to make any other objections relating thereto. Protests shall describe or otherwise identify the property owned by the person or persons ' making the protest. Protests shall be filed with the City Recorder of Bountiful, Utah, on or before 2:00 O'CLOCK P.M., on June 11, 1975 Thereafter at 4:00 O'CLOCK P.M. on June 11, 1975, the City Council will meet in public meeting at the City Hall to consider all protests so filed and hear all objections relating relat-ing to the proposed Special ' Improvement District.
