Show FRAUD ALLEGED IN ACTION OVER STOCK W. L. Grover Says He Was Swindled in a Coal Deal. Salt Lake, April 17. Alleging fraud. W. L. drover of Garland, Hox Elder county, brought suit against E. S. Kimball. R. A. Shlpp and the Utah National Na-tional bank. In the Third district court, Friday, to recover $500 on a promissory promis-sory note alleged to have been executed execut-ed to the defendants, October Z'. 1908, for worthless stock in the People's Coal and Coke company. The bank Is made defendant to restrain it from disposing dis-posing to the note. Grover says thai Kimball and Shlpp falsely represented to him that the coal and coke company owned property proper-ty in Carbon county bearing a thirty-foot thirty-foot vein of coal, sufficient to furnish the needs of the state. The producing capacity of the property prop-erty was represented to him as being 200 tons a day for 100 years, Grover says, and under the representation that the company needed $25,000 to build yards and do other similar work In Salt Lake City and that tho slock was easily worth 50 cents a share, Grover purchased 1000 shares $500 worth, he alleges. ' Hie complaint sets out that Daniel and Margaret Manning of Garjand were induced to give a note for $2000 for 4.000 shares, and A. L. Grover. also of Garland, a note for $500 for 1.000 shares, under similar representations, which Grover says were false, and these transactions are -made a part of this complalnl, the aggregate amount or the suit being $3,000. with Interest from date of notes, and costs of tho sulL |
