It was held that the evidence was not sufficient to sustain the allegation alle-gation of negligence on the part of the company. The suit arose from the explosion of a missed hole in the drift on the sixth level of the company's mine In Bingham Bing-ham canyon, on March 7, 1907. On that day, the plaintiff states that he was put to work in the mine. He had drilled drill-ed two holes with the machine drill and was well along with the third one when the missed charge was struck, the explosion of which caused the loss of both his eyes as well as fracturing his skull, breaking his left arm and leg and also three ribs. The suit was for $10,000 damages. |
