COURT DEFERS TRIAL j OF JAMES FOGARTY; Absence of Governor-elect Bamberger as Important Witness Delays Counterfeit Case. Tiie trial of Jame. Eos-arty, charged with having counterfeit silver dollars in his possession, was delayed in tiie fed-cral fed-cral court yesterday, owing to the nonappearance non-appearance of Governor-elect Simon Bamberger, Bam-berger, who had been subpoenaed to attend at-tend to give testimony for the defense. It was explained to Judge Tillman D. Johnson that the governor-elet had gone to Washington to attend a conference of governors, in company with Governor Hpry and Senator-elect Wiiliam H. King, who is going to Washington for a conference con-ference with President Wilson and national na-tional Democratic leaders. Wiien tne case was called yesterday Attorney At-torney Tliomas Marioneaux, counsel for Fogarty, noted the absence of the governor-elect and called the matter to the attention of the court. Inasmuch as Mr. Bamberger's testimony was to prove that Eoearty bore a spotless reputation prior to his present predicament, Fogarty having hav-ing recently been in the employ of the Bamberger interurban line. Attorney Marioneaux explained to the court that in justice to his client tiie verbal testimony of tiie governor-elect was quite Indispensable, Indis-pensable, and requested that the case lie continued until such time as he could take the witness stand.
