Show ALLEGES SLANDER IN DAMAGE ACTION O. N. Friendly, superintendent of the Dalv-Judge mine at Park City, filed suit in the Third district court yesterday to recover 50' damages from Frank Mc-Ewan Mc-Ewan for alleged slander. The plaintiff alleges that the defendant made statements to the effect that the plaintiff had violated the state law against peonage. It is alleged in the complaint that on January 7, 1916, McEwan said of Friendly, in the presence of several witnesses, "He ought to be making money with the bohunks he is hiring." It is set forth In the complaint that the defendant wished to convey the impression im-pression that Friendly was receiving money from some of the miners for giving giv-ing thorn employment. The plaintiff fur-ther fur-ther alleges that the defendant was heard to say that the Daly-Judge company was receiving from J5 to $10 a day from each of the "bohunks." The plaintiff alleges that in making these statements the defendant de-fendant falsely accused the plaintiff of violating section 1, chapter 53, of the state statute, which forbids peonage. |
