Show ROSENIM. ARRESTED j 81 OCOEfJ OFFICERS May Face Charge of Concealing Con-cealing Assets Involved in Bankruptcy. Spe-dal to The Tribune. (X ; HEX, July 13. After a three days ' search in which representatives of his creditors were also interested, deputies from the slier i tf 's office succeeded suc-ceeded today in locating D. Rosenthal, proprietor of the recently defunct Golden Eagle clothing store, and placed him under arrest oo a warrant charging that he passed a worthless cheek with intent to defraud. The complaint was issued by County Attorney .Joseph E. Evans at the request of l. A. Moves, cashier of the Commercial National bank. In addition to the local criminal charge, Rosenthal may also have to face criminal charges of a federal nature na-ture for alleged concealment of goods involved in connection with involuntary bankruptcy. Following his arrest today to-day Kosenthal was given a preliminary examination before United States Commissioner Com-missioner 8. T. Corn on the creditors' petition filed in the United States district dis-trict court at Bait Lake on July 6. The petition was filed bv Attorneys W. R. and .T. D. Wkeen, "who represent eastern creditors, holding claims totalling total-ling about $0,U00. Those creditors are for the most part wholesale shoe and clothing firms from which Rosenthal purchased goods. There are said to be many other claims, which will bring the total up to $30,OUi). Among the latter is the Commercial National bank of this citv, with a claim said to be more than $4000. With total liabilities of about $30,000 Rosenthal's assets are said to total only $5000. In this connection attorneys for tho eastern creditors contend there is an . unaccountable shortage of about $12,000 worth of goods, which may result re-sult in a federal criminal charge. Several mouths ago Rosenthal, in addition ad-dition to operatng the clothing store in this city, purchased a clothing stock and opened a store at Eureka. During the past few weeks most of his time has been spent at the Eureka store, the Ogden establishment having been left in the care of clerks. At the examination yesterday "Rosenthal "Rosen-thal testified that not more than five dozen pairs of shoes had been diverted to tho Eureka store after being shipped to his store in this city. He also denied de-nied that any large amount of goods had been sold or transferred to other parties except tho goods regularly retailed. re-tailed. It is expected that a hearing ou the petition for involuntary bankruptcy bank-ruptcy will be held in the United States' district court within the next three weeks, the preliminary examination today to-day having been an extraordinary -proceeding because of the alleged heavy shortage of goods, as indicated by the purchases and sales from the two stores. On tho local criminal charge it is alleged that Rosenthal drew a check for $2,10 on tho Commercial National bank payable on a note held by the bank. It is contended that the erstwhile erst-while merchant knew there was not sufficient suf-ficient money to his credit to cover the check. After the federal examination this afternoon Rosenthal was released from the custody of Sheriff T. A. De-Vine De-Vine on a bond furnished by his friends. |
