Judge Alfred Budge of tho district court yps-. terday announced his decision in tho case of several parties against the Southern Idaho Water Power company, in which groat damages were claimed for flooding, and. aside from tho Judgment Judg-ment for damages sustained by hay crops, set aside tho judgment ngainst the company. About 53S00 was collected a few weeks ago from patrons of the company by tho sheriffs of Bannock. Bingham nnd Poer counties, which satisfied a judgment for loss of hay. Tin judgments set aside were In favor of Froda Sparks. S26.1M0; Walter Sparks. $21,750; E. E. White. 526.910; W. W. White. 526.100; E. J. Twomey, 55850; Is'. Smith. 58750; American Falls Development De-velopment company. 32500; Philbrlck it Greenwood, $12,000. and T. 13. St. John. 52500. Phllbrick & Greenwood were allowed al-lowed 5n50 for attorneys' foes. There Is probability of an appeal from this decision de-cision to tho supremo court. |
