Show WRIT ISSUED 1 CASE OF AGED AGITATOR Supreme Court of Colorado Takes Action in Case of "Mother" Jones. DENVER, Colo.. April S. The supreme court late today Issued a writ of habeas corpus for tho release of "Mother" Mary Jones, now held as a military prisoner in the coal strike zone at Walsenburg. The writ Is returnable In ten days. The petition upon which the writ was issued today was tiled April a by Horace 7s. Hawkins, attorney for the United Mine Workers of America. The court was asked to take original jurisdiction. It was tho third application for a. writ. During tho detention of "Mother" Jones, the Sli-ycar-old utrlko leader, in a hospital at Trinidad, the first application was made to the supreme court. It was denied on February 18, on tho ground thut the lower court should lirst pass upon the case. Tho second application was mado to the district court or Las AnlmaK county, which denied tho application, sustaining the authority of Governor Amnions to Imnrinon "Mother" Jones under the decision de-cision of tho supremo court In the Moyer cane. It was planned then to appeal to the supromc court. This plan was abandoned when "Mother" Jones was released and brought to Denver a few weeks ago, accompanied ac-companied bv a military escort. Upon her return to tho strike district of southern south-ern Colorado, "Mother" Jones was again arrested and detained at Walsenburg by order of the governor. Tn the petition upon which the court acted today it is contended that the issues is-sues aro Identical with those upon which tho dlBtrlct court had given its decision and that further action beforo the district court Is unnecessary. |
