Show ACTING MINISTER OF INTERIOR EXPLAINS OTTAWA. Ont.. Sept. 10. C. J. Doher-ty, Doher-ty, as acting minister of the interior de partment, today nald he had rejected Thaw's appeal rrom the decision of the Immigration board of Inqulrj'i upholding tho findings of the board and ordering the deportation of Thaw forthwith. The order was carried out this morning. The writ of habeas corpus or writ of prohibition Issued at Montreal, said Mr. Doherty. did not enjoin tho Immigration authorities from taking this step. "J issued the warrant for the deportation deporta-tion of Thaw which has been acted on this morning. I did It in pursuance of my duty as acting minister of the Interior," In-terior," said Judge Doherty. "I assume full responsibility for the deportation. The action has beon taken after careful consideration. What was done was merely to carry out the law." Explains Situation. Judge Dohorty explained that the Canadian Ca-nadian Immigration law directed Hie seizure of persons who were suspected of being undesirable, their examination by! a board of Inquiry and deportation. "Thaw was suspected, seized, examined, condemned as an undesirable and now has been sent back whence he came and 'by the same route," added Judge Dohcrty, Do-hcrty, "What about the court orders, the writ of prohibition and the writ of habeas corpus'.'" he was asked. "There has been a good deal of misunderstanding misun-derstanding on these points." replied Judge Doherty. "There was no writ of prohibition directed to the authorities who had Thaw In custody. As for the writ of habeas corpus It was directed to the officer who had Thaw In custody bc-foro bc-foro the hoard of Inquiry took action. It directed the official to produce Thaw on Monday. By the operation of the Immigration Im-migration law. Thaw passed from the possession of the officer to whom the writ of habeas corpus had been directed. Ho came by operation of the law into possession pos-session of other officials. There was no court order restricting them and nothing to prevent them executing the order for deportation." "Yes," replied Judge Doherty. "It was considered and wc found the law directs that an undesirable be deported by the route by which he entered tho country. This Is what we have done."
