Show rVIARSHALL DECIDES PARK CITY SLIT By a ruling of Judge John Marshall Mar-shall in tbe federal court in Salt Lake today, the suit brought by Mrs. Char-lotto Char-lotto Cassidy, a widow of the late James P. Cassidy, against the Silver King Coalition Mine company, to compel com-pel an accounting for more than $2,-000,000 $2,-000,000 worth of ore extracted from the Captain lode, is decided aversely to the complainant, the court sustaining sustain-ing the demurrer of the defendant corporation. Tho suit was filed Dec. 1, 1908 and upon the death of James P. Cassidy his widow contlnuec the action, claiming the right to an accounting by virtue of alleged ownership of one-quarter Interest Jn the Captain lode. In his ruling Jufflge Marshall declared de-clared the fact that rourteen years had elapsed between the granting of tho patent on the property and the suit for an accounting, demoustrated that tho defendant had failed to properly prop-erly safeguard his interests and that tho action in law bad been taken too late. |
