SHEEN I j In an answer filed in the district court, Saturday evening, the Ogden j Rapid Transit company sets forth a ! number of reasons way It should not be compelled to stop Its cars at the Lewis Rosort In Ogden canyon, as piayed for by J. D. Skecn. The answer an-swer covers a number of pages of legal cap paper. In places It being quite facetious. It Uenied all the material ma-terial facts stated In the petition filed by Skeen, In which he asks for a writ of mandamus against the company to compel them to 6top their cars at the Lewis place. Skeen is frequently referred to In I the answer .'as a "bird of passage," and with no property rlehts in the canyon which would give him a license to demand of the company as to what points In the canyon It should stop Its cars. The street railway company says It owns only sixteen feet right of way through the lewls resort, and If passengers pas-sengers are allowed to alight from j Its cars at that point they would be trespassers ''and the company would be accessories. That Skeen Is a busy-body and mischief-maker is one of the charges of the company. His complaint is demurred to on the grounds of a lack of Jurisdiction of the district court. After listening to the arguments Saturday afternoon. District Judge Howell announced that he would take I the matter under advisement and would render his decision later. |
