The blow spilt Brim-hall's Brim-hall's ljp and knocked him to the paved sidewalk, from whence ho was taken to the pollco station, where hla wound was sowed by Dr. "V. B. Whal-en. Whal-en. Maxwoll was lator arrested by Patrolman C. P. Fitzgerald and charged with assault and battery. He wns trlod in the municipal court this mornlnt; and found not guilty. According to the burden of testimony 'in tho case, Brlmhall and a companion compan-ion came to the city last night from Proston. Whllo walking up Twenty-fifth Twenty-fifth street, across from City Hall Park, they passed Maxwell, Ray Hillon and "Whitoy" Johnson, all of Ogden. To this trio, the out-of-town boys ap-pearod ap-pearod to be staggering slightly as they walked and Johnson, referring to thorn in a tone of voice loud enough for thorn to hear, said, "I guess they opened a bottlo of soda-pop and smelled the cork." Brimhall took umbrago at the remark re-mark and, turning around and assuming assum-ing an aggressive tone, asked: "Who said that?" Maxwell took responsibility for the statement and received a. challenge to ftght. yie accepted, hut said that it would bo bettor to got off tho street to stage the battle. Brlmhall, however, how-ever, seemed in a hurry and, as a result re-sult of his haste, stopped the first blow, which was registered by Maxwell. Max-well. This did no sorious damage but surprised tho Preston youth for a moment and when he recovered he ojaculated, "Who hit mq?' Maxwell confessed and said, "I hit you and will hit you again if you don't keep away." By this time a crowd had gathered and, as Brlmhall made a movo to get into action, Maxwell Max-well struck tho blow that landed tho Preston lad on the pavement and himself him-self in jail. The judge held that the injured youth was the aggressor in the fight and discharged tho defendant. Charles Ross, W. F. Taylor. Joo Miller Mil-ler and J. C. Cooley, arunks, were each sentenced to serve 5 days In jail. J. Currey, arrested for drunkenness, forfeited 55 ball. |
