Show ?apsf grefs fe sentence FARMINGTON A 20 year-old Clinton man with developmental de-velopmental disabilities was sentenced from 10 years to life in the Utah State Prison for sexually abusing the 8-year-old daughter of a I girlfriend. Victor Michael Milewski was sentenced by Second District Court Judge Rodney S. Page and ordered to pay the cost of counseling for the victim. Before the sentence was imposed, Milewski's court appointed at-I at-I tomey, Stephen Oda, asked Page to weigh the mitigating circumstances cir-cumstances of his client's home environment and substantial disabilities. Oda presented testimony from his client's brother Richard, who was also present in the court. Oda said Milewski's troubles with the law coincided with the time Richard left home, leaving his client in the care of an invalid mother and an alcoholic, absentee stepfather. Richard took on the responsibility of being a parent and when he left home, Victor fell in with the wrong crowd and started having problems with drugs and alcohol, he said. Oda also pointed out Milewski had been in special education classes since the third grade and had difficulty reading and writing. He said his client could be rehabilitated at his young age and asked Page to consider minimal incarceration. "I know Ive committed a crime. I have a girlfriend that's four-and-a-half months pregnant. I want to get an education and a job in drafting. 1 don't want to be locked up' Milewski said. But Page said psychological profiles showed there was a high risk Milewski might commit similar offenses. After weighing the aggravating ag-gravating and mitigating circumstances, Page said he could not justify moving from the median sentence normally imposed for the I crime. He said Milewski would be considered for the youth offender and sex abuse program at the prison. Milewski was originally charged with rape of a child, object rape of a child and sodomy on a child, but pleaded guilty to one amended charge of sodomizing a child in a plea bargain agreement with county coun-ty prosecutors. |
