C. Evans, restraining the commission from interfering with the sale of stock by the United States Wool company, on the ground that the law as passeil by the Thirteenth session ses-sion of the legislature was invalid through an error in engrossing, mav not hold. " Suit fur a writ of prohibition was begun by the -wool company after it had been refused a license to sell stock in the state of Utah. The action was brought on the ground that the law had been nullified by mistakes of tbe engrossing committee. The findings of the court were in accord with the contention con-tention of counsel. Attorncv Thomas Kamage, with regard to the technicality and held that the error voided the law. As the bill went from the house of the last legislature to the senate, it contained in paragraph four the words, "filing a statement with the commission." commis-sion." On the first reading in the senate, sen-ate, the language was amended by addition addi-tion to make it read, "filing a statement state-ment with the commission and receiving receiv-ing a license therefrom." ' Ou second reading in. the senate the words so add-ed, add-ed, "and receiving a license therefrom," there-from," were stricken, and again restored re-stored upon the third reading, making the language to read, as by first amendment amend-ment in the senate, "filing a statement state-ment with the commission and receiving a license therefrom.'' The bill as so amended 'was passed by the house, but it was engrossed and signed as first passed by the house without the senate amendments, and as never passed by the senate. The new biH y.s passed by the legislature legis-lature recreated the securities commission commis-sion and approved all of its actions in the time since it was first created by the former bill, which was in error. - |
