Show MRS. CARDONER'S MINE SUIT DISPOSED OF SAN FRANCISCO, Oct. 6. Heirs of Mn, Mnthildc Cardoner, widow of I)a-111 I)a-111 iu it C;irdoner, Idaho mine operator, must neecpt $50,000 for her one-sixteenth interest in the Hercules mine, an Idaho property reputed to be worth .jtO,-.00(1,01)0, .jtO,-.00(1,01)0, the United States circuit court of appeals decided here today in sotting aside atl action by Mrs. Cardoner to invalidate in-validate a payment she received for that amount. Mrs. Cardoner held that she was influenced in-fluenced to sell the interest and other property for $:170,000 through fraud i practiced bv Kugene R. Day, executor of her husband s estate. Day and a number of others were joined with the Hercules company s defendants. The United States district, court of Idaho hldd that she had been sufficiently suf-ficiently advised of tho transaction and that no fraud hail been attempted.
