A potltion was presented today in tlio Stove Adams trial by the counsel for the defense, nskini; tlio court to enter an order permitting the defense to subpoena witnesses in the case at Hie cost of tlio state, basou" on the plea that the defense was without money and unable to boar tho burden of this cost. The counsel stated ' that unless the state stood this expense the defense would be unable to produce the bulk of its witnesses. The prosecutiou opposed the request, and the court took it under consideration. considera-tion. Blank subpoenns have already been issued for tho witnesses for the defense, but so far no record has been made of the number of witnesses or their names. When court adjourned for the noon recess there were eleven -jurors in the Tiox who had beep passed by both sides I on tho examination for clullenges for causes. The exercise of the right for j peremptory challenges, of which each ! side has thirt, resulted in the excusing excus-ing of four jurors up to noon, two for the prosecutiou and two for the defense'. de-fense'.
