Show GAVE MORTGAGE UPOX WRONG PIECE OF GROUND Tuesday afternoon Judge Morse look up the case of Lucius L. "Woodruff against E. P. Sears aud wife in the equity division of the third district court. Woodruff alleges that ho deed ed a part of lot S, block 27, pint. TP, to Mrs. Sears early in J9Dlr upou fhe jigroemont of Sears to give him a uote for $1000, signed by F. N. lugulls aud .secured by a mortgage upon 1G0 acres of land eight miles west of the citv. It was also agreed, Woodruff says, that a -cbideuce building, to cost $1500, was lo be erect d upon the grouud. Woodruff alleges that tho note and mortgage were given, but that the mortgage is not upon tho piece of ground that it should have been upon, lie therefore asks that tho deed which I he executed be set aside. i |
