The East Jordan Canal coinpan3 lias filed an answer to tlic eonipluint, of Salt j Lake City in tho puit recently instituted by the municipal corporation for i lie purpose of condemning a right-of-way in the canal and enlarging it so as to carry ji larger volume of water, which tho city needs on lands that, are too high to be reached by the eily canal. The canal company denies that the city is entitled to JSi cubic feet of water wa-ter flowing in the canal, and denies that the city needs the additional water sought. It also is alleged that the right-of-way of the canal is not large enough for the proposed enlargement by the city. "In conclusion, it is alleged that no resolution or ordinance has ever been adopted, or passed by the City Council, nut.liori7.ing the city's action, and that, the resident taxpayers have not had an opportunity to protest, against or pass upon it, and thai the action of the city is illegnl. |
