Five thousand dollars damages was obtained from the Rio Grande Western Railway company In Judge Ritchie's court yesterday. Edward A. Steed was the plaintiff, by Clara W. Steed, his wife and guardian. Steed la mentally Incompetent. He was so rendered. It Is aliened, by tho uccl-dent uccl-dent for which ho sued tho company. His wife was appointed by tho court guardian ad litem of the Injured man. Tho action was to recover ?7&00 damages. Judgment was given by stipulation, the company's attorneys having compromised tho case. Steed Is a farmer living at Farmlngton. While driving his team over a grade crossing cross-ing ho was struck by an engine. The horses were killed and tho wagon was demolished. Steed was thrown somo thirty feet by the engine- When picked up he was found to be .suffering from a compound fracture of the skull, besides other severe Injuries. This becamo traumatic trau-matic neurasthenia, rendering the victim mentally Incompetent. The case for tho plaintiff was that he had no warning of the approach of the locomotive. Tho engineer did not whistle, nor was the bell rung. Tho view of tho driver wan obstructed by tho banks of a high cut at the point where the road creases the railroad track. |
