Fi-2 Residents Should Be Aware Over the years, residents of Bountii'ul's east side hae become be-come UNed to watching complacently com-placently the frequent zoning battles that take place on the city's uest side. Now, whether they know it or not. the residents resi-dents of the R-2 zone (lower east side I are in for a battle themselves. I hey had better wake up now or they might wake up on August 2$ and find that their R-2 zone is not much different from R-3. This is what's happening: 1. ON Wednesday, July 30, the Bountiful City Council set a date and a time for a public hearing to consider amending the city's zoning ordinance as it applies to land zoned R-2 throughout the whole city. The amendment has not been made public (and even may not have been w ritten) but the council's discussion indicates indi-cates that the amendment would cange the ordinance to permit, on a "conditional use" basis, the building of condominiums condomi-niums (multiple unit dwellings) in areas zoned R-2, to the same density ( 10 units per acre) that would be allowed in areas zoned R-3. 2. THE term "conditional use" is not well defined, if it is defined at all. In this case it appears to mean that if a land owner or developer wants to take advantage of its provisions, provi-sions, he must present a definite defi-nite plan for developing the land. Then, if permission is granted, he can proceed with that plan but none other. If permission per-mission is denied, he can resubmit re-submit the same plan at later times or may submit other plans if he so desires. 3. IF neighbors object to the plan they must do something to make their objections known to the city council. Being unaware una-ware or too late or not having sufficient clout or a strong enough argument all these can lead to defeat for the neighbors. neigh-bors. Until we see the amendment we will not know, but there may be no notice given to the neighbors other than a legal notice in the Clipper and an item on the agenda of a city council meeting. IN EFFECT, the neighbors are put in a position of having to defend themselves against the law rather than being protected pro-tected by the law. The whole process can be accomplished in 15 day s. A person on vacation vaca-tion could miss it from beginning begin-ning to end. You may ask, "Why is this happening?" It is a consequence consequ-ence of the desire of the city council to accommodate two land owners who last month request rezoning of approximately approxi-mately 5.8 acres of land from R-2 to R-3 so that they could build 48 units of condominium type multi-unit dwellings.
