Monson trial postponed by CHRISTOPHER SMART Record staff writer Jon Bryan Monson, charged in the September 1984 slaying of a co-worker whose decomposed body was found east of Oakley, Monday waived his right for a speedy trial because the court had scheduling conflicts. , Monson's first-degree murder trial had been scheduled1 for 'Sept.-1 17. But Third District Court Judge J; Dennis Frederick said he could not preside over the trial at that date. The Salt Lake City man voluntarily agreed to a trial date change on advice from Summit County public defender Thomas Quinlan. Judge Frederick rescheduled the trial for Oct. 8. Monson recently completed a 30-day psychiatric evaluation at the Utah State Hospital. Quinlan would not comment on the evaluation, which has not been made public. '. Quilan stated earlier that his client's mental capacity could have been diminished at the time of the murder of Phillip W. Kirby, 22, West Valley City. Quinlan said there is a distinction between a defense based on diminished capacity and one based on insanity. Kirby's badly decomposed body was found May 5 buried beneath a pile of rocks on a farm owned by the I Monument Stake of the Church of Jesus Christ of Latter-day Saints. The Summit County Sheriff's office was informed of the location of the body by Doug Monson, manager of the farm and brother of the suspect. Police believe Kirby was shot twice with a .44-caliber Magnum handgun. The murder weapon has not been found. Monson has been held on $100,000 bond since his arrest three months ago. |
