Show CONTINUANCE GRANTED STATE IN GARRETT AND FLEMING HEARING HEAR-ING IN POLICE COURT. Attorney for Defendant Objected to a Further Postponement February 11 Set for the Hearing. The case of robbery against John K. Garrett and James Fleming came up for hearing in the municipal court this morning.." County Attorney Jensen asked for a continuance of the case under the plea that the principal witnesses, Fred and Vera Loveless, were still absent from the state and that as they hal been located and an effort was being made to secure their presence in the near future, there was a probability of their returning to the city. Attorney Maglnnls, for the defense, objected to a continuance of the case, stating that one of the defendants was confined at the county Jail on account of his inability to obtain work for the support of his family while the present charges were hanging over him, and that, as there was little prospect of the state being about to produce the witnesses wit-nesses in question, further continuance was inadvisable. The court upheld the state in its demand for a continuance and ordered that the same be granted, the day of hearing being set for February 11. |
