Show lodge Agee Dismisses Case Against Sialey The case against Clyde Stalcy, charged with having taken and driven an automobile without knowledge or consent of the owner, was dismissed in the district court this morning by Judge A. W. Agee. In his decision Judge Agee hold that a recent Jaw which provides punishment for persons per-sons operating an automobile belonging belong-ing to another, without permission, either, with or without intent to steal, was not applicable in the case of an automobile salesman, who is employed by an automobile concern. The law would be applicable however, the judge ruled, if an understanding was reached between tho firm and the salesman that the cars could only bo used upon asking consent of tho owner in each instance a car was to be taken tak-en out, and the salesman did not obtain ob-tain this permission. ' Staley was alleged to have taken a car belonging to thc WHfong-Glas- Imann Automobile company, without knowlcdgo or consent of tho owners i and to have driven it. He was em- ' t ployed by the automobile company at tho time. |
