Show ELECTION NOTICE To ALL QUALIFIED ELECTORS ELEC-TORS OF THE CITY OF ST. GEORGE CITY, UTAH: Take notice that on the 29th day of May, 1941, an election will be held in the City of St. George U' . , at the placos so; . ai in the following ordinance, and! for the purpose of submitting to the qualified voters of said City the question set out in an ordinance ordi-nance accepted by the City Council on April 22, 1941, which ordinance is as follows: ORDINANCE 151 "AN ORDINANCE providing for the holding of a special election in the City of St. George City, Utah, for the purpose pur-pose of submitting to the qualified quali-fied electors thereof the question ques-tion of adopting an Initiative Ordinance with respect to granting grant-ing to the Southern Utah Power Company a fifteen (15) year franchise to operate within the city limits and furnish patrons therein with electrical energy." WHEREAS, there has this day been presented to the City Council Coun-cil an initiative petition requesting that the City Council adopt the ordinance therein set out or submit sub-mit such ordinance to the vote of the qualified electors of the City of St. George City for adoption, said ordinance being entitled: "An initiative ordinance accepted accep-ted on April 22, 1941, by the City Council subject to the approval by the voters granting to Southern Utah Power Company a fifteen (15) year franchise to operate within the City limits and to furnish furn-ish patrons therein with electrical energy; and WHEREAS, it has been ascertained ascer-tained by the City Council that at the last preceding election for governor held in the City of St. George City there were cast for all candidates a total of 1400 votes, and it has been determined by the City Council that the initiative in-itiative petition for the above entitled en-titled ordinance is signed by 287 legal voters qualified to sign said petition, and that said petition contains the number of qualified signers required by Chapter X of Title 25 of the Revised Statutes of Utah, 1933; and WHEREAS, said initiative petition peti-tion has been in all respects carefully care-fully examined and has been found by the City Council to be full and complete, and to comply in all respects with the requirements of said Chapter X;. and WHEREAS, the ordinance set out in said petition has been adopted by the City Council subject sub-ject to approval of the qualified electors of the City of St. George City, and it is desired to call a special election at which the question of the approval of said ordinance may be referred to the electors of the City of St. George City qualified to vote thereon; NOW, THEREFORE, Be It and It Is Hereby Ordained by the City Council of the City St. George City, Washington County, Utah, as follows: Section 1. That there shall be held in said City on the 29th day of May, 1941, between the hours of seven o'clock A. M., and seven o'clock P. M., a special election at which there shall be submitted to the legal voters of said City the question of the approval of the ordinance described in the preamble pre-amble hereto. Section 2. That all electors of the City of St. George City qualified quali-fied to vote on said proposition under the provisions of the constitution consti-tution of Utah and Title 25 of the Revised Statutes of Utah, 1933, as amended, shall be permitted per-mitted to vote at said election. Section 3. That the polls shall be opened in every regularly established es-tablished election district of said City on the day of said election, which districts, voting places and the election officials to serve in each district, are as follows: District No. 10: East Precinct; Voting Place: Annie C. Johnson residence at 83 East Tabernacle Street. Election Officials: Judges of Election, Charles Walter Cottam, Cot-tam, Ambrose Cannon and Sabra Foremaster. Constable, Emerald Cox. District Number 11: West Precinct. Pre-cinct. Voting Place: A. B. Andrus residence, 108 So. 100 West. Election Elec-tion Officials: Judges of Election, Elec-tion, Jessie Empey, J. R. Fawcett and W. A. Whitehead. Constable, D. Wilson Woodward. Section 4. That the registration registra-tion agents for the several election elec-tion districts of said City shall, between the hours of eight o'clock A. M., and nine o'clock P. M., on the first and third Tuesdays immediately im-mediately preceding said election, receive and register the names of all persons applying for registration registra-tion who are legally qualified and entitled to vote at such election or who will legally have acquired a residence (being otherwise qualified!, qual-ified!, and who will have a right to vote at said election according to the provisions of the law under which said election is to be held. Section 5. That the registration registra-tion agent for each election district dis-trict shall post in at least five (51 conspicuous places within his district at least five (51 days prior to the date fixed for said election the following election notice, which election notice shall llso be p:iM!.hoS once a week for not less than four consecutive weeks in five issues in the Washington Wash-ington County News, a newspaper published and enjoying a general circulation in the City of St. George City: (Here follows the form of Notice No-tice hereby given). Section 6. That said election shall be held in all respects, and notice thereof shall be given in all respects, as required by the general laws of Utah pertaining to special municipal elections. Section 7. That the proposition to be submitted, and the ballot to be used at said election shall be in substantially the following form, it being understood that said ballot bal-lot shall comply in all respects with the requirements of Chapter X, and Section 5 of Chapter VI of Title 25, Revised Statutes of Utah, 1933, as amended: ORDINANCE NO. 150 "An initiative ordinance or-dinance accepted on April 22, 1941, by the City FOR I I Council subject to1 the approval by the voters granting grant-ing to the Southern Sou-thern Utah Pow- AGAINST I I er Company a fifteen fif-teen (15) year franchise to operate op-erate within the City limits and to furnish patrons therein with electrical energy." The ballot title appearing in said ballot has been provided by the City Attorney and approved by the City Council. Section 8. That the City Recorder Re-corder is instructed and directed direc-ted to prepare the publicity pamphlet pam-phlet required by Sections 18 and 23 of Chapter X, Title 25, Revised Statutes of Utah, 1933, to incorporate incor-porate therein the arguments for and against the measure filed with him, in accordance with the provisions of said Section 23, and to distribute said pamphlets to every voter of the City of St. George City, either by mail or carrier, not less than eight (8) days prior to the date herein fixed for the election, at which said proposition is to be voted upon. Section 9. That immediately after its adoption this ordinance shall be signed by the Mayor and City Recorder, shall be recorded in a book kept for that purpose, and shall be published in the Washington County News, a newspaper news-paper published and having a general gen-eral circulation in the City of St. George City, and shall take immediate effect, the preservation of the peace, health and safety of the City of St. George City so requiring.
