The council granted the petitioner a request to give final approval of the annexation an-nexation in a special council meeting April 19 which is the day before an election elec-tion for the Naples City to incorporate. Attorney Kenneth Anderton, who is handling the annexation for the property proper-ty owners in the industrial area, told the council that nearly 60 percent of the 166 property owners in the annexation had signed a petition to annex into the city. Those who have signed the petition represent 70 percent of the assessed value of the area. To annex into the city, ci-ty, 50 percent of the property owners and 30 percent of the assessed value should be represented by the petition signers. Property owners have been preparing prepar-ing the annexation for almost a year since a prior annexation into the city was settled at 500 South Highway 40 after a lengthy law suit with Uintah County. The proposed annexation extends east of the Vernal Municipal Airport to 2000 East and goes to 1700 South. "The concern we have," said one property pro-perty owner in favor of the annexation, "is we live in Vernal City now and with a new city where we own property, it would be taxation without representation." representa-tion." "We want to be annexed and as quickly quick-ly as possible," Alvin Kay, who owns property in the proposed annexation, said. Anderton said that the property owners have instructed him that if the proposed Naples City incorporation to form a city is passed, lo file a petition to disconnection from the new city. Councilman Karl Migliori said that the city's intent in annexing the area the first time was obvious a tax grab, and he didn't approve of it. Migliori said that when the first annexation was settled at 500 South the council agreed to accept petitions from those out of the city by the settlement of the suit between bet-ween the city and county. Attorney Mark Nash, who resides in . the Naples area, told the council that "undoubtedly if the Naples City incorporation incor-poration passes there will be a law suit." Nash requested the council to postpone the final approval of the annexation an-nexation until after the election to incorporate in-corporate Naples City April 20. Migliori told Nash that if the council delayed the annexation it may cause the property owners undue legal fees. The council also approved an annexation annexa-tion of 57 acres at 250 North 1500 West which imposes on the proposed Maeser City incorporation up for election May 25. Both property owenrs of the parcel have signed a petition to annex. Final approval of this annexation will be next month. The council approved a resolution not to accept annexations into the city from the present area encompassed by the Maeser Water and Sewer Improvement District. In other business the council approved approv-ed a motion to file an injunction against the Maeser Water Improvement District if they tapped the 20-inch water line from Ashley Springs. Maeser proposed to tap the line to the Chocolate Rock water tank with a 20-inch line. The city council contended that a 20-inch tap on the line would divert more than Maeser's one-eighth share of the line. The council approved business licenses for Don Craig, Hunter Chambers, Park City; Robert Parker, Goldstar Realty, 46 S. 600 W.; Lloyd Brothers Construction, Heber; Rainbow Rain-bow Neon Sign Co., Salt Lake City; Randy Millecam, R&R Sound Selections, Selec-tions, 870 W. 100 S.; Michael Mahan, Randy Gould, Bradford Hold, CDC Service Ser-vice and Repair, 164 N. 625 E.; Peterson Enterprises, Payson; and Verden C. Heaton, Reidhead Enterprises, Ashley Valley Big O Tire, W. Highway 40. |
