A,e two parties met to argue a -tion and set trial date on tne an" esation suit before Judge J. Robert jlock early Tuesday. At that time the masked the district's attorney for a Ration to settle out of court. According to the county's attorney, -jrk Allred, a stipulation had been -iwnupover a year ago by the county settle at 500 south which the city reed to. If the judge had made a ruling on jcase we would have lost the entire j Vexation," commented Mayor Samuel Snyder, Tuesday. Earlier Bullock ruled that the city could only count each property owner once even if he owned more than one partial in the annexation and that the city needed to obtain the signatures of all property owners on each partial. Because of this ruling the city was found short in the number of petitions . needed to annex property along U-40 east. of 500 East. Judge Bullock will make the formal order on the settlement in about 10 days. The stipulation provides that the area along U-40 south of 500 South on the east side of town will be in Uintah County and the area north of 500 South will be in the city. Originally the city had obtained annexation petitions for a dog-legged area which extended past 1500 South, but the county contested the annexation say the city was seeking a lucrative tax base. Over $750,000 in sales tax, held by the court since the county contested the annexation, will be divided proportionately propor-tionately to each entity according to the 500 South and U-40 division. The stipulation also provides that property owners can request annexation an-nexation of land south of 500 South into the city. Mayor Snyder said that it was better to settle at 500 South in the long run in that property owners south of that point can now annex back into the city. |
