Johnson, Weber eounty farmer, serving a life sentence for the murder of a neighbor. The Utah state board of pardons Monday afternoon was to act on an application for termination of sentence of David H. Johnson, 65-year-old Weber county farmer now serving a life sentence for the second sec-ond degree murder of a neighbor, John Kap, May 19, 1936, In a dispute dis-pute over Irrigation water. The only witness to appear before be-fore th pardon board, conducting Its monthly meeting at the state prison, was Mrs. John Kap, widow of the man Johnson shot, who protested pro-tested his release. The board continued until Its February meeting action on the application for termination of sentence sen-tence of Harry Patmor, 59, who is now serving a maximum term of 25 years for an attempted bombing and five years for perjury In a liquor liq-uor case. Patmor and Melvin Hll-liard Hll-liard were convicted of attempting to take the life of Arlyn K. Thur-man, Thur-man, agent of the state liquor control con-trol commission, to prevent his testifying tes-tifying at the liquor violation trial. The bomb failed to explode. The board, which waa to act on 19 cases, had completed action on the following before late afternoon: after-noon: Everett Anderson, third degree burglary, termination denied; F. H. Bench Jr., assault with intent to commit rape, paroled effective Im-i Im-i mediately. He has served two years and eight day of a one to 10 year sentence. William H. Bloomfleld. assault with a deadly weapon, termination denied; Grady Boulter, second degree de-gree burglary, termination denied; Robert John Dahlquist, grand larceny, lar-ceny, termination denied; Bernell Flanlgan, second degree burglary, William Flygare, grand larceny, application for termination withdrawn with-drawn at the request of his mother, Mrs. O. W. Flygare of West Jordan; Jor-dan; Daniel Martinez, attempt to commit grand larceny, sentence terminated on the condition he be deported to Mexico. Although it did not appear on the day's calendar of cases, the board was expected to consider action ac-tion on Robert Earle, 32, parolee of the prison who was "recently arrested in San Francisco on a charge of burglary with explosives. explo-sives. It was expected that the board would terminate Earle's parole and attempt to return him here to serve the remainder of a three to 20 year term for assault with a deadly weapon. He was paroled In 1937 after serving six months of" the sentence. |
