IS 11 The degree of drunkenness of a person operating oper-ating a motor vehicle Is a subordinate subor-dinate consideration In the light of a Utah statute. City Judge H. A. Belnap aald Monday In sentencing Kenneth Julian, 23, of Salt Lake City, to serve 30 days in Jail or to pay $100 fine for drunken driving. Julian testified he had drunk a "water glass size of wine," but did not consider the "drink" of sufficient suf-ficient quantity to Influence his control of an auto. Judge Belnap, who said the state of intoxication of a driver la not for the court to determine, granted him a day's stay of execution. |
