Decision of the district court of Weber county was reversed yesterday by tho supremo court in the case of Emma Chandler against the state industrial in-dustrial commission, A. M. Miller and the Aetna Life Insuraneo company. Mrs. Chandler applied to the industrial commission for compensation, alleging that her husband had died as 1 ho result of a bite from a mad dog while in tho employ of A. M. Miller of Ogden, who is the owner of the Washington market. mar-ket. The application was denied by the commission and the matter was taken into tho district court were a demurrer filed by the defendant was sustained and the eas6 was then appealed to the supremo court. It was held by Justice J. E. Frick, who wrote the opinion, that the district dis-trict court had erred in sustaining the demurrer and the case wiuj ordered back to the district court for further hearing. The question in the case was whether or not Chandler was performing his duties du-ties as a driver of a delivery truck at the time he was bitten by the dog. Mrs. Chandler held that he was, because be-cause he was forced to go to the home of Miller in order to get the truck which was kept there in a garage at night. It was while on his way for the truck that he met the dog. This was on January 26, 191S, she said. On March 22, 191S. he became ill, and March 25 died of hydrophobia. |
